Synopsis As Introduced
Amends the Attorney General Act. Makes a technical change in a Section concerning the Attorney General's oath and bond.

Replaces everything after the enacting clause. Amends the Illinois Public Aid Code. Makes changes concerning Medicaid eligibility of persons otherwise eligible for basic maintenance under the AABD (Aid to the Aged, Blind or Disabled) and TANF (Temporary Assistance for Needy Families) programs. In connection with FamilyCare eligibility under the medical assistance program, authorizes the Department of Healthcare and Family Services to implement those provisions by adopting certain rules contained in the Illinois Administrative Code, with changes concerning countable income eligibility standards. Adds special provisions to provide that the Department of Healthcare and Family Services may submit to the Comptroller, and the Comptroller is authorized to pay, on behalf of persons enrolled in the FamilyCare Program, claims for services rendered to an enrollee during the period beginning October 1, 2007, and ending on the effective date of any rules adopted to implement the provisions of the amendatory Act; provides that the authorization for payment of claims applies only to bona fide claims for payment for services rendered. Provides that each person enrolled in the FamilyCare Program as of the effective date of the amendatory Act whose income exceeds 185% of the Federal Poverty Level, but is not more than 400% of the Federal Poverty Level, may remain enrolled in the FamilyCare Program pursuant to these added special provisions so long as that person continues to meet the eligibility criteria. Provides that in no case may a person continue to be enrolled in the FamilyCare Program pursuant to these added special provisions if the person's income rises above 400% of the Federal Poverty Level or falls below 185% of the Federal Poverty Level at any subsequent time, but that nothing contained in these added special provisions shall prevent an individual from enrolling in the FamilyCare Program as authorized by other provisions of the Code. Effective immediately.
