Synopsis As Introduced
Amends the Illinois Insurance Code. Deletes language that provides that moneys in the Insurance Financial Regulation Fund may be transferred to the Professions Indirect Cost Fund, as authorized under the Department of Professional Regulation Law of the Civil Administrative Code of Illinois.

House Committee Amendment No. 1
Adds reference to:
215 ILCS 5/224from Ch. 73, par. 836

Further amends the Illinois Insurance Code. Makes changes to the standard provisions for life policies. Sets forth certain information that an insurer may require a beneficiary to provide. Provides that due proof of loss shall consist of information and documents necessary for the insurer to determine its liability, pay the proceeds, and be discharged from liability. Makes other changes.

House Floor Amendment No. 2
Deletes the provisions concerning the items that an insurer may require a beneficiary to provide and provides instead that proof of death shall be in writing and establish (1) the fact and date of the insured's death, (2) the claimant's identity, and (3) the claimant's interest and the extent thereof. Provides that such proof includes information and documents necessary for the insurer to determine its liability, pay the claim in compliance with all laws and regulations, and be discharged from liability. Restores current law concerning the payment of interest to all policies.

Governor Amendatory Veto Message
Recommends that the provisions concerning proof of death and due proof of loss be deleted; proposes instead that a life insurance policy may require that due proof of the death of the insured shall consist of a certified copy of the death certificate of the insured or other lawful evidence and may require proof of the claimant’s interest. Makes recommendations concerning the accruing of interest at the annual rate of 9% on the proceeds payable unless payment is made within 15 days after certain conditions occur.
