Synopsis As Introduced Amends the Illinois Controlled Substances Act. Establishes penalties for the knowing manufacture or delivery of, or possession with intent to manufacture or deliver, fentanyl. Provides that 3 years shall be added to the term of imprisonment and the maximum sentence shall be increased by 3 years if the substance containing a controlled substance contains any amount of fentanyl (except for violations in which the controlled substance is fentanyl). Amends the Unified Code of Corrections. Provides that probation, periodic imprisonment, or conditional discharge may not be imposed for the knowing manufacture or delivery of, or possession with intent to manufacture or deliver, more than 5 grams of a substance containing fentanyl. Effective immediately.
