Synopsis As Introduced
Amends the Department of Professional Regulation Law and the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. In a Section allowing the Director of Professional Regulation to suspend certain licensing requirements after the proclamation of a disaster by the Governor for persons working for the Illinois Emergency Management Agency (IEMA) and the Department of Public Health, provides that working for IEMA may also include working for an emergency services and disaster agency accredited by IEMA and that working for the Department of Public Health may also include working for a local public health department. Makes corresponding changes to a Section granting similar license suspension powers to the Director of Public Health. Effective immediately.

 Fiscal Note (Emergency Management Agency)
 The liability to the State is not determined because one could not speculate whether or not the state would be sued. However, it is reasonable to expect that in a major response to an incident that some volunteers working for IEMA may be injured, which could result in a workers compensation claim. It is also possible that some volunteers could be sued in tort actions by third parties, which would invoke the liability provisions of section 8(d) of the Court of Claims Act.

House Floor Amendment No. 1
Adds reference to:
20 ILCS 3305/10from Ch. 127, par. 1060

Deletes everything after the enacting clause. Reinserts the provisions of the bill as introduced. Provides that volunteers who are working under the direction of an emergency services and disaster agency accredited by the Illinois Emergency Management Agency, pursuant to a plan approved by the Illinois Emergency Management Agency (i) during a disaster declared by the Governor under Section 7 of this Act, or (ii) in circumstances otherwise expressly approved by the Illinois Emergency Management Agency, shall be deemed exclusively employees of the State for purposes of Section 8(d) of the Court of Claims Act, provided that the Illinois Emergency Management Agency may, in coordination with the emergency services and disaster agency, audit implementation for compliance with the plan. Effective immediately.
