Synopsis As Introduced
Amends the State Officials and Employees Ethics Act. Requires that the quarterly reports of an Inspector General be available to the public (now, to an executive branch constitutional officer or the General Assembly and to the appropriate ethics commission) and include the number of (i) complaints deemed valid to warrant investigation and (ii) investigated State employees in categories of disposition. Makes violation of the confidentiality of an Inspector General's investigatory files and reports a Class 4 felony. Effective immediately.

Deletes everything after the enacting clause. Amends the State Officials and Employees Ethics Act. Makes violation of the confidentiality of (i) the identity of an investigation source or (ii) an Inspector General's investigatory files and reports a Class A misdemeanor. Provides that those confidentiality requirements do not preclude an authorized recipient of the confidential information from disclosing it when necessary to the recipient's employees. Permits an ultimate jurisdictional authority to provide a redacted copy of a confidential investigatory report to a person whose alleged misconduct or violation is a subject of the report if the Inspector General approves the redaction; permits that person to further disclose information in the redacted report with the prior approval of the ultimate jurisdictional authority (except that the person may disclose to his or her personal attorney or union representative without the ultimate jurisdictional authority's prior approval in the case of an Executive Inspector General's report). Effective immediately.
