Synopsis As Introduced
Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that no person shall sell a gift certificate that is subject to an expiration date or a fee. Provides that the face value of a gift certificate may not be reduced in value and the holder of a gift certificate may not be penalized in any way for non-use or untimely redemption of the gift certificate. Deletes language requiring that a gift certificate subject to a fee or expiration date contain a statement clearly and conspicuously printed on the gift certificate stating the expiration date or whether there is a fee. Makes other changes.

 Would neither increase nor decrease the number of judges needed in the state.

House Floor Amendment No. 1
Replaces everything after the enacting clause. Reinserts the provisions of the original bill with the following changes. In the provision prohibiting the sale of gift certificates that are subject to an expiration date or a fee, provides that the prohibition applies to sales of gift certificates on or after January 1, 2007 and that it prohibits the sale of those gift certificates that have an expiration date or a post-purchase (instead of only purchase) fee. Restores language allowing a fee on a gift certificate purchased prior to January 1, 2007. Makes other changes.
