Synopsis As Introduced
Amends the Illinois Public Aid Code in relation to rights and responsibilities of applicants and recipients. Prohibits discrimination on account of marriage status. Provides that the Department of Human Services and the Department of Public Aid may not discourage persons from making applications for benefits under the Code, and makes other changes concerning the application process. Requires the establishment of review procedures in cases of termination of benefits for reasons other than financial eligibility or death of the recipient. Requires determinations of eligibility for other assistance. Requires that a recipient with employment or earned income be provided with information concerning Family Assist, Family Care, and available education and training opportunities. Makes other changes. Effective immediately.

Deletes everything after the enacting clause. Amends the Illinois Public Aid Code. Prohibits discrimination on account of marital status. Provides that participation in any marriage promotion or family formation activity is voluntary and that non-participation shall not affect any person's eligibility for or receipt of financial aid or social services in any program under the Code. Provides that when a public aid recipient has employment or earned income, the Department of Public Aid must provide the recipient with information concerning the Family Assist and Family Care programs and the education and training opportunities available to recipients. Effective immediately.

Deletes everything after the enacting clause and reinserts the provisions of House Bill 3023 engrossed, except (i) prohibits discrimination based on marital (instead of marriage) status and (ii) provides that the Department of Human Services and the Department of Public Aid are not prevented from treating individuals differently as a result of the rights and responsibilities that arise under law from marital status. Further amends the Illinois Public Aid Code with changes that include the following: (1) provides that provisions prohibiting a family receiving TANF from receiving an increase in aid solely on account of the birth of a child do not apply to affect the monthly assistance amount of any family as a result of the birth of a child on or after January 1, 2004; provides that as resources permit after January 1, 2004, the Department of Human Services may cease applying those provisions to limit assistance to families receiving TANF assistance on January 1, 2004, with respect to children born prior to that date; and provides that in any event, those provisions limiting assistance shall be completely inoperative on and after July 1, 2007; and (2) makes various changes in provisions concerning the education, training, and employment program for TANF recipients. Effective immediately.
