Synopsis As Introduced
Creates the Unsolicited Commercial Electronic Mail Act. Prohibits sending unsolicited commercial e-mail advertisements from Illinois or to an Illinois electronic mail address. Provides that if the above provisions or their application are held invalid, these alternative provisions become operative: the sender of an unsolicited commercial e-mail advertisement shall maintain a functioning return e-mail address for requests not to receive further advertisements and the advertisement shall include a specified notification regarding making such a request; a person may not initiate transmission of an unsolicited commercial e-mail advertisement either from Illinois or to an Illinois e-mail address as specified; the subject line of a commercial e-mail advertisement shall include specified text; and no person may sell or provide a list of e-mail addresses to be used to initiate the transmission of unsolicited commercial e-mail advertisements from Illinois or to an Illinois e-mail address. Authorizes the recipient of a commercial e-mail advertisement transmitted in violation of the Act to bring an action to recover the greater of actual damages or $500 per individual violation, and costs and attorney's fees. Authorize the court to increase the award if the violation was willful or knowing. Contains applicability provisions. Makes violation a Class C misdemeanor and an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act (and amends that Act accordingly).
