Synopsis As Introduced
Amends the Environmental Protection Act. Provides that a person commits the offense of Criminal Disposal of PCBs if he or she disposes of, or accepts for disposal, PCBs or PCB Items regulated under Subpart D of 40 C.F.R. 761 at a site or facility that is less than 500 feet above an aquifer that currently provides the only source of potable water for a community water supply serving a municipality with a population in excess of the entire population of the county where the site or facility is located, according to the last U.S. Decennial Census. Effective immediately.

Replaces everything after the enacting clause. Amends the Environmental Protection Act. Specifies that any site or facility for the treatment, storage, or disposal of polychlorinated biphenyls (PCBs) or PCB Items regulated under Subpart D of 40 C.F.R. 761 that is located less than 500 feet above an aquifer that currently provides the only source of potable water for a community water supply is a pollution control facility. Provides that, in the case of a site or facility for the treatment, storage, or disposal of polychlorinated biphenyls (PCBs) or PCB Items regulated under Subpart D of 40 C.F.R. 761 that is located less than 500 feet above an aquifer that currently provides the only source of potable water for a community water supply, local siting approval must be obtained by the county board of each county located, in whole or part, within the aquifer's boundaries and the governing body of each municipality located, in whole or part, within the aquifer's boundaries. Provides that no site or facility for the treatment, storage, or disposal of polychlorinated biphenyls (PCBs) or PCB Items regulated under Subpart D of 40 C.F.R. 761 that is located less than 500 feet above an aquifer that currently provides the only source of potable water for a community water supply shall commence or continue treating, storing, disposing of, or accepting for treatment, storage, or disposal any polychlorinated biphenyls (PCBs) or PCB Items, unless the owner or operator of that site or facility submits proof to the Agency that the operation of the facility on and after the effective date of the amendatory Act has been approved by ordinances duly adopted by the county board of each county located, in or whole in part, within the aquifer's boundaries and the governing body of each municipality located, in or whole or part, within the aquifer's boundaries. Effective immediately.
