Synopsis As Introduced
Amends the Illinois Human Rights Act. With respect to real estate transactions, prohibits discrimination on the basis of source of income.

House Committee Amendment No. 1
Replaces everything after the enacting clause with provisions similar to those of the bill as introduced, except provides that "source of income" means any lawful income, subsidy, or benefit with which an individual supports himself or herself and his or her dependents (instead of meaning the source of any lawful income or any lawful rent payment).

House Floor Amendment No. 2
With respect to the State's public policy to prevent discrimination based on source of income in real estate transactions, provides that that public policy recognizes the need for mixed-income housing. Provides that nothing in the Section of the Illinois Human Rights Act concerning civil rights violations with respect to real estate transactions, or in any municipal or county human rights ordinance, prohibits the consideration of source of income in connection with any housing development project in which 25% or more of the units either (i) are owned by a public housing authority or (ii) receive rental subsidies authorized under Section 8 of the United States Housing Act of 1937 or receive any other local, State, or federal rental subsidy or benefit.

 In the opinion of DCCA, HB 1352 (HA #1,2) creates a local government organization and structure mandate for which reimbursement of the increased costs to units of local government is not required under the State Mandates Act. An estimate of the increased costs to units of local government is not available.

 Fiscal Note (Department of Human Rights)
 As a result of a prior source of income study, the Department of Human Rights anticipates minimal fiscal impact if HB 1352 passes.

 As a result of a prior source of income study, the Department of Human Rights anticipates minimum fiscal impact if HB 1352 (as amended by HA #1) becomes law.

 Fiscal Note (H-AM 2) (Department of Human Rights)
 As a result of a prior source of income study, the Department of Human Rights anticipates minimum fiscal impact if HB 1352 (as amended by HA #2) becomes law.

 Housing Affordability Impact Note (H-AM 1 & 2) (Housing Development Authority)
 There will be no fiscal effect on the cost of constructing, purchasing, owning or selling a single-family residence.
