Synopsis As Introduced Creates the Fire Department Promotion Act. Requires municipal fire departments and fire departments operated by a fire protection district to make promotions in accordance with the Act. Requires the preparation and publishing of promotion lists. Sets components that may be included in the promotion process. Sets requirements for written examinations, the award of seniority points, the award of ascertained merit points, subjective evaluations, and the award of veterans' preferences. Sets penalties for violations of the Act. Preempts home rule. Contains other provisions. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
House Committee Amendment No. 1 Excludes a combined department that was providing both police and firefighting services on January 1, 2002.
Senate Committee Amendment No. 1 Changes the definitions of the terms "affected department" and "promotion". Makes changes concerning the procedure used when making an appointment when a promotional rank is created or becomes vacant. Makes changes concerning the monitoring of the promotion process. Provides that certain portions of the Act do not apply if they violate the provisions of a collective bargaining agreement. Removes provisions granting examinees the right to documentation of an explanation of the basis or reasons for the scores awarded on promotion tests. Provides that performance evaluations that are used as a basis for promotions are not subject to grievance procedures.
Senate Floor Amendment No. 3 Defines the term "rank". Changes the definition of "affected department" and "department" and "promotion". Makes changes concerning certain actions authorized under the Act. Makes changes concerning annual evaluations. Provides that local authorities and exclusive bargaining agents affected by the Act may agree to waive one or more of its provisions and bargain on the contents of those provisions.
