Synopsis As Introduced
Amends the Illinois Public Aid Code. Provides that a dependent of a military service member, who is a legal resident of the State, having previously been determined to be eligible for developmental disability services provided by the Department of Healthcare and Family Services, including waiver services provided under the home and community based services programs authorized under Section 1915(c) of the Social Security Act, shall retain eligibility for those developmental disability services as long as he or she remains a legal resident of the State, regardless of having left the State due to the military service member's military assignment outside the State. Provides that if the State eligibility requirements change, the dependent shall retain eligibility until new information is provided by the dependent or military service member to the Department. Contains provisions concerning assessment determinations; eligibility determinations for dependent's who return to the State following a period of absence and who request services including waiver services provided under the home and community based services programs authorized under Section 1915(c) of the Social Security Act; federal waiver application; and rulemaking authority. Effective immediately.

Replaces everything after the enacting clause. Reinserts the provisions of the bill as introduced, but with the following changes: Amends the Department of Human Services Act. In provisions concerning a disability database maintained by the Department of Human Services, provides that the Department shall allow legal residents who are dependents of a military service member and who are absent from the State due to the member's military service to be added to the database to indicate the need for services upon return to the State. Provides that should an individual in such a situation be selected from the database to receive services, the individual shall have 6 months from the date of the selection notification to apply for services and another 6 months to commence using such services; and that in the event an individual is receiving services funded by the Department and the services are disrupted due to the military service member's need for the individual to leave the State because of his or her military service, the services shall be resumed upon the individual's return to the State if the dependent is otherwise eligible. Provides that no payment shall be made for home and community based services provided outside the State of Illinois. Requires dependents of military service members to provide certain documents. Further amends the Illinois Public Aid Code. Provides that a dependent, who is a legal resident of the State, having previously been determined to be eligible for developmental disability services provided by the Department of Human Services (rather than the Department of Healthcare and Family Services), including waiver services provided under the home and community based services programs authorized under Section 1915(c) of the Social Security Act, shall retain eligibility for those developmental disability services as long as he or she remains a legal resident of the State, regardless of having left the State due to the military service member's military assignment outside the State, and as long as he or she is otherwise eligible for such services. Removes language providing that if the State eligibility requirements change, the dependent shall retain eligibility until new information is provided by the dependent or military service member to the Department. Provides that the Department of Human Services shall permit a dependent who resides out-of-state to be placed on the waiting list for developmental disabilities services if the dependent left the State due to the military service member's military assignment outside the State, is otherwise eligible for those services, and furnishes certain documents (rather than the Department of Human Services shall direct that developmental disability services shall be provided to a dependent if the dependent is otherwise eligible for those services and furnishes certain documents). Prohibits payments for developmental disability services authorized under the Illinois Title XIX State Plan and provided outside the State with some exceptions. Prohibits payments for home and community based services provided outside the State of Illinois. Effective immediately.
