Synopsis As Introduced
Amends the Boat Registration and Safety Act. Removes an exclusion to certain provisions requiring the use of personal flotation devices for sailboats and adds an exclusion to the same provisions for sailboards. Provides that no person may operate a watercraft under 26 feet in length on public or private property (rather than on just public property) unless certain personal flotation devices are being properly worn by a sole occupant and each person under the age of 13 (rather than just each person under the age of 13) on board the watercraft at all times in which the watercraft is underway. Effective immediately.

Senate Committee Amendment No. 1
Modifies the definition of a sole occupant.

Senate Floor Amendment No. 2
Provides that the requirement that no person may operate a watercraft under 26 feet in length on public or private property unless certain personal flotation devices are being properly worn does not apply to a person using an electric motor intermittently to maneuver the watercraft for short distances while fishing.

House Committee Amendment No. 1
Provides that the requirement that no person may operate a watercraft under 26 feet in length on public or private property unless certain personal flotation devices are being properly worn does not apply to a person using an electric motor or the primary gas engine (rather than just an electric motor, as provided by the engrossed bill) intermittently to maneuver the watercraft for short distances while fishing.

House Committee Amendment No. 2
Provides that the personal flotation device provision of the introduced bill, as amended, does not apply to privately-owned, impounded bodies of water that are located on one parcel of property.
