Synopsis As Introduced
Contains a preamble concerning Coronavirus Disease 2019 (COVID-19), the Gubernatorial Disaster Proclamations declaring all counties in the State of Illinois as a disaster area through April 30, 2020, and other matters. Defines "health care facilities", "health care professional", and "health care volunteer". Pursuant to the Illinois Emergency Management Agency Act, for the duration of the Gubernatorial Disaster Proclamations: directs health care facilities, health care professionals, and health care volunteers to render specified assistance in support of the State's response to the disaster recognized by the Gubernatorial Disaster Proclamations; and directs that health care facilities, health care professionals, and health care volunteers shall be immune from civil liability for injury or death alleged to have been caused by acts or omissions by the health care facilities, health care professionals, and health care volunteers while rendering assistance to the State by providing health care services in response to the COVID-19 outbreak, with specified exceptions for gross negligence or willful misconduct. Provides that nothing in this Executive Order shall be construed to preempt or limit any applicable immunity from civil liability available to any health care facility, health care professional, or health care volunteer. Provides that the provisions of this Executive Order are severable.
