SYNOPSIS AS INTRODUCED:
 
770 ILCS 60/6  from Ch. 82, par. 6

    Amends the Mechanics Lien Act. Provides that the changes made by Public Act 97-966, to provisions governing the circumstances in which it is not necessary to fix by contract a time for the completion or a time for payment in order to obtain a lien under the Act, are operative during the 5-year period that begins on the effective date of this amendatory Act and are inoperative after the expiration of the 5-year period. Effective immediately.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mechanics Lien Act is amended by changing
5Section 6 as follows:
 
6    (770 ILCS 60/6)  (from Ch. 82, par. 6)
7    Sec. 6. In no event shall it be necessary to fix or
8stipulate in any contract a time for the completion or a time
9for payment in order to obtain a lien under this act, provided,
10that the work is done or material furnished within three years
11from the commencement of said work or the commencement of
12furnishing said material in the case of work done or material
13furnished as to residential property; and within 5 years from
14the commencement of said work or the commencement of furnishing
15said material in the case of work done or material furnished as
16to any other type of property. The changes made by Public Act
1797-966 are operative during the 5-year period that begins on
18the effective date of this amendatory Act of the 99th General
19Assembly and are inoperative after the expiration of the 5-year
20period. The changes made by this amendatory Act of the 97th
21General Assembly become inoperative 3 years after the effective
22date of this amendatory Act of the 97th General Assembly.
