AMENDMENT TO SENATE BILL 1582

2    AMENDMENT NO. ______. Amend Senate Bill 1582, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Vehicle Code is amended by
6changing Section 11-1414.1 as follows:
 
7    (625 ILCS 5/11-1414.1)  (from Ch. 95 1/2, par. 11-1414.1)
8    Sec. 11-1414.1. School transportation of students.
9    (a) Every student enrolled in grade 12 or below in any
10entity listed in subsection (a) of Section 1-182 of this Code
11must be transported in a school bus or a vehicle described in
12subdivision (1) or (2) of subsection (b) of Section 1-182 of
13this Code for any curriculum-related school activity, except a
14student in any of grades 9 through 12 or a student in any of
15grades K though 12 with an Individualized Education Plan (IEP)
16with a staff to student ratio of 1 to 5, and attending Acacia

1Academy, Alexander Leigh, Marklund, Helping Hands Center,
2Connections Organization, or New Horizon Academy may be
3transported in a multi-function school activity bus (MFSAB) as
4defined in Section 1-148.3a-5 of this Code for any
5curriculum-related activity except for transportation on
6regular bus routes from home to school or from school to home,
7subject to the following conditions:
8        (i) A MFSAB may not be used to transport students under
9    this Section unless the driver holds a valid school bus
10    driver permit.
11        (ii) The use of a MFSAB under this Section is subject
12    to the requirements of Sections 6-106.11, 6-106.12,
13    12-707.01, 13-101, and 13-109 of this Code.
14    "Curriculum-related school activity" as used in this
15subsection (a) includes transportation from home to school or
16from school to home, tripper or shuttle service between school
17attendance centers, transportation to a vocational or career
18center or other trade-skill development site or a regional safe
19school or other school-sponsored alternative learning program,
20or a trip that is directly related to the regular curriculum of
21a student for which he or she earns credit.
22    (b) Every student enrolled in grade 12 or below in any
23entity listed in subsection (a) of Section 1-182 of this Code
24who is transported in a vehicle that is being operated by or
25for a public or private primary or secondary school, including
26any primary or secondary school operated by a religious

1institution, for an interscholastic, interscholastic-athletic,
2or school-sponsored, noncurriculum-related activity that (i)
3does not require student participation as part of the
4educational services of the entity and (ii) is not associated
5with the students' regular class-for-credit schedule shall
6transport students only in a school bus or vehicle described in
7subsection (b) of Section 1-182 of this Code. This subsection
8(b) does not apply to any second division vehicle used by an
9entity listed in subsection (a) of Section 1-182 of this Code
10for a parade, homecoming, or a similar noncurriculum-related
11school activity.
