AMENDMENT TO SENATE BILL 1582

2    AMENDMENT NO. ______. Amend Senate Bill 1582 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 11-1414.1 as follows:
 
6    (625 ILCS 5/11-1414.1)  (from Ch. 95 1/2, par. 11-1414.1)
7    Sec. 11-1414.1. School transportation of students.
8    (a) Every student enrolled in grade 12 or below in any
9entity listed in subsection (a) of Section 1-182 of this Code
10must be transported in a school bus or a vehicle described in
11subdivision (1) or (2) of subsection (b) of Section 1-182 of
12this Code for any curriculum-related school activity, except a
13student in any of grades 9 through 12 or a student in any of
14grades K though 12 with an Individualized Education Plan (IEP)
15with a staff to student ratio of 1 to 5, and attending Acacia
16Academy, Alexander Leigh, Marklund, Helping Hands Center,

1South Campus, New Connections Academy, Connections Day School,
2Connections Academy East, Virtual Connections Academy,
3Transitions School, New Horizon Academy, or The Hope Institute
4for Children and Families may be transported in a
5multi-function school activity bus (MFSAB) as defined in
6Section 1-148.3a-5 of this Code for any curriculum-related
7activity except for transportation on regular bus routes from
8home to school or from school to home, subject to the following
9conditions:
10        (i) A MFSAB may not be used to transport students under
11    this Section unless the driver holds a valid school bus
12    driver permit.
13        (ii) The use of a MFSAB under this Section is subject
14    to the requirements of Sections 6-106.11, 6-106.12,
15    12-707.01, 13-101, and 13-109 of this Code.
16    "Curriculum-related school activity" as used in this
17subsection (a) includes transportation from home to school or
18from school to home, tripper or shuttle service between school
19attendance centers, transportation to a vocational or career
20center or other trade-skill development site or a regional safe
21school or other school-sponsored alternative learning program,
22or a trip that is directly related to the regular curriculum of
23a student for which he or she earns credit.
24    (b) Every student enrolled in grade 12 or below in any
25entity listed in subsection (a) of Section 1-182 of this Code
26who is transported in a vehicle that is being operated by or

1for a public or private primary or secondary school, including
2any primary or secondary school operated by a religious
3institution, for an interscholastic, interscholastic-athletic,
4or school-sponsored, noncurriculum-related activity that (i)
5does not require student participation as part of the
6educational services of the entity and (ii) is not associated
7with the students' regular class-for-credit schedule shall
8transport students only in a school bus or vehicle described in
9subsection (b) of Section 1-182 of this Code. This subsection
10(b) does not apply to any second division vehicle used by an
11entity listed in subsection (a) of Section 1-182 of this Code
12for a parade, homecoming, or a similar noncurriculum-related
13school activity.
