AMENDMENT TO SENATE BILL 1380

2    AMENDMENT NO. ______. Amend Senate Bill 1380, on page 1, by
3replacing line 5 with the following:
 
4"changing Sections 11-20-15 and 11-20-15.1 and by adding
5Section 9-2-4.10 as follows:
 
6    (65 ILCS 5/9-2-4.10 new)
7    Sec. 9-2-4.10. Special assessment for payment of costs
8associated with unpaid utility bills. In addition to any other
9method authorized by law, if a lien with respect to any unpaid
10utility bills has been filed against a property, then those
11costs associated with the lien may be treated as an existing,
12judicially-approved special assessment, as though an
13assessment warrant had been issued and all conditions precedent
14had been satisfied. The municipality may collect those costs as
15a special assessment on the property if it complies with the
16applicable procedures set forth under Section 9-2-80 through

1Section 9-2-98. In such cases, the county recorder or other
2officer of the county in which the municipality is located that
3has the authority to receive State and county taxes and the
4court rendering judgment and ordering sale of the delinquent
5special assessment shall exempt the municipality from the
6otherwise applicable special assessment warrant and certified
7assessment roll requirements because the same will be deemed to
8have occurred by operation of law. Upon payment of the costs by
9the owner of record or persons interested in the property,
10including any cost incurred by the municipality for collecting
11the costs under this Section, the lien shall be released by the
12municipality and the release shall be filed of record in the
13same manner as the filing of notice of the lien.".
