30 ILCS 805/8.39 new

    Amends the Illinois Governmental Ethics Act. Expands definition of "late term appointee" to include a person who is appointed as a director, executive director, or other similar officer by a board, commission, authority, task force, or other similar group, authorized or created by State law where the Governor appoints one or more members, 90 or fewer days before the end of the then-serving Governor's term, when the then-serving Governor does not succeed himself or herself as Governor. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Governmental Ethics Act is amended
5by changing Section 3A-5 as follows:
 
6    (5 ILCS 420/3A-5)
7    Sec. 3A-5. Definitions. As used in this Article:
8    "Late term appointee" means a person who is appointed to an
9office by a Governor who does not succeed himself or herself as
10Governor, whose appointment requires the advice and consent of
11the Senate, and whose appointment is confirmed by the Senate 90
12or fewer days before the end of the appointing Governor's term.
13"Late term appointee" also means a person who is appointed as a
14director, executive director, or similar officer by any body 90
15or fewer days before the end of the then-serving Governor's
16term, when the then-serving Governor does not succeed himself
17or herself as Governor. For purposes of this paragraph only,
18"body" means a board, commission, authority, task force, or
19other similar group authorized or created by State law where
20the Governor appoints one or more members of the board,
21commission, authority, task force, or other similar body.
22    "Succeeding Governor" means the Governor in office
23immediately after a Governor who appoints a late term

3    Section 90. The State Mandates Act is amended by adding
4Section 8.39 as follows:
 
5    (30 ILCS 805/8.39 new)
6    Sec. 8.39. Exempt mandate. Notwithstanding Sections 6 and 8
7of this Act, no reimbursement by the State is required for the
8implementation of any mandate created by this amendatory Act of
9the 99th General Assembly.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.
