AMENDMENT TO SENATE BILL 1256

2    AMENDMENT NO. ______. Amend Senate Bill 1256 on page 46,
3immediately below line 19, by inserting the following:
4    "(aaa) Notwithstanding any provision in this Section to the
5contrary, nothing in this Section shall prohibit the issuance
6or renewal of a license authorizing the sale of alcoholic
7liquor within a full-service grocery store at premises located
8within a municipality with a population in excess of 1,000,000
9inhabitants and within 100 feet of a school if:
10        (1) the sale of alcoholic liquor is not the primary
11    business activity of the grocery store;
12        (2) the premises are newly constructed on land that was
13    formerly used by the Young Men's Christian Association;
14        (3) the grocery store is located within a planned
15    development that was approved by the municipality in 2007;
16        (4) the premises are located in a multi-building,
17    mixed-use complex;
18        (5) the entrance to the grocery store is located more

1    than 200 feet from the entrance to the school;
2        (6) the entrance to the grocery store is located across
3    the street from the back of the school building, which is
4    not used for student or public access;
5        (7) the grocery store executed a binding lease for the
6    property in 2008;
7        (8) the premises consist of 2 levels and occupy more
8    than 80,000 square feet;
9        (9) the owner and operator of the grocery store
10    operates at least 10 other grocery stores that have
11    alcoholic liquor licenses within the same municipality;
12    and
13        (10) the director of the school has expressed, in
14    writing, his or her support for the issuance of the
15    license.".
