1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fire Hydrant Act is amended by adding
5Section 2 as follows:
 
6    (425 ILCS 20/2 new)
7    Sec. 2. Recovery of costs; fire hydrant.
8    (a) As used in this Section, "fire hydrant" means a water
9hydrant connected to a water supply system installed for the
10express purpose of providing water for fire suppression and
11that a fire department can connect to and from which it can
12pump or draw water. "Fire hydrant" does not include flush
13hydrants.
14    (b) Whoever fails to comply with any of the provisions of
15this Act within 30 days after written notice of noncompliance
16or violation should reasonably have been received from a fire
17protection district, township fire department, or municipality
18in whose jurisdiction a fire hydrant is located, shall be
19responsible for all reasonable costs that the fire protection
20district, township fire department, or municipality incurs to
21correct the noncompliance, including attorney's fees and legal
22expenses incurred by the fire protection district, township
23fire department, or municipality in recovering the costs from

1the responsible party.
 
2    Section 99. Effective date. This Act takes effect upon
3becoming law.
