1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Open Meetings Act is amended by adding
5Section 2.03.5 as follows:
 
6    (5 ILCS 120/2.03.5 new)
7    Sec. 2.03.5. Internet posting requirements.
8    (a) A public body that serves a population of less than
91,000,000 that maintains an Internet website other than a
10social media website or social networking website shall, within
1190 days of the effective date of this amendatory Act of the
1299th General Assembly, post to its website for the current
13calendar year a mechanism, such as a uniform single email
14address, for members of the public to electronically
15communicate with elected officials of that public body, unless
16such officials have an individual email address for that
17purpose.
18    (b) In addition to any requirement to publish in any
19newspaper notices, agendas, records, or other information or
20material that is required to be published in a newspaper by law
21or court order including, but not limited to, this Act, the
22Illinois Municipal Budget Law, the Intergovernmental
23Cooperation Act, the Counties Code, the Township Code, the

1Illinois Municipal Code, the Election Code, the School Code,
2the Airport Authorities Act, or the Civic Center Code, a public
3body that maintains a website shall also publish this
4information on its website.
5    (c) For the purposes of this Section, "Internet website"
6shall not include any social media website, social networking
7website, or any other social media presence that a public body
8maintains.
9    (d) A hyperlink to the information required to be posted
10under this Section must be easily accessible from the public
11body's home page.
12    (e) The postings required by this Section are in addition
13to any other posting requirements required by law or ordinance.
14    (f) No home rule unit may adopt posting requirements that
15are less restrictive than this Section. This Section is a
16limitation under subsection (i) of Section 6 of Article VII of
17the Illinois Constitution on the concurrent exercise by home
18rule units of powers and functions exercised by the State.

20    Section 10. The Local Records Act is amended by repealing
21Section 20.
