SYNOPSIS AS INTRODUCED:
 
50 ILCS 205/20

    Amends the Local Records Act. When required to publish in a newspaper, requires all units of local government and school boards that maintain a website to additionally publish notices, agendas, records, or other information or material that is required to be published in a newspaper by law or court order to their website.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Local Records Act is amended by changing
5Section 20 as follows:
 
6    (50 ILCS 205/20)
7    Sec. 20. Internet posting requirements.
8    (a) A unit of local government or school district that
9serves a population of less than 1,000,000 that maintains an
10Internet website other than a social media website or social
11networking website shall, within 90 days of the effective date
12of this amendatory Act of the 98th General Assembly, post to
13its website for the current calendar year a mechanism, such as
14a uniform single email address, for members of the public to
15electronically communicate with elected officials of that unit
16of local government or school district, unless such officials
17have an individual email address for that purpose.
18    (a-5) In addition to any requirement to publish in any
19newspaper notices, agendas, records, or other information or
20material that is required to be published in a newspaper by law
21or court order including, but not limited to, the Open Meetings
22Act, the Illinois Municipal Budget Law, the Intergovernmental
23Cooperation Act, the Counties Code, the Township Code, the

1Illinois Municipal Code, the Election Code, the School Code,
2the Airport Authorities Act, or the Civic Center Code, a unit
3of local government or school board that maintains a website
4shall also publish this information on its website.
5    (b) For the purposes of this Section "Internet website"
6shall not include any social media website, social networking
7website, or any other social media presence that a unit of
8local government or school district maintains.
9    (c) A hyperlink to the information required to be posted
10under this Section must be easily accessible from the unit of
11local government's or school district's home page.
12    (d) The postings required by this Section are in addition
13to any other posting requirements required by law or ordinance.
14    (e) No home rule unit may adopt posting requirements that
15are less restrictive than this Section. This Section is a
16limitation under subsection (i) of Section 6 of Article VII of
17the Illinois Constitution on the concurrent exercise by home
18rule units of powers and functions exercised by the State.
