AMENDMENT TO HOUSE JOINT RESOLUTION 90

2    AMENDMENT NO. ___. Amend House Joint Resolution 90 by
3replacing everything after the heading with the following:
 
4    "WHEREAS, The Governor claims that local units of
5government are constrained by State law in their ability to
6bargain with their employees; and
 
7    WHEREAS, The Governor claims that collective bargaining
8has led to higher property taxes and hindered the economic
9growth of the State; and
 
10    WHEREAS, The General Assembly wishes to encourage
11development within the State, encourage responsible use of tax
12dollars, and ensure the fair treatment of Illinois' highly
13skilled and valuable public sector employees; and
 
14    WHEREAS, The General Assembly seeks to implement laws and

1policies that balance the interests of taxpayers and local
2governments with the interests of educators, public safety
3employees, and other vital public servants;
 
4    WHEREAS, The Governor, along with business interests,
5claims that the current civil justice system in Illinois allows
6for venue shopping, the targeting of deep pocketed defendants,
7and inflated medical expense verdicts, all of which the
8Governor claims have hindered the economic growth of the State;
9and
 
10    WHEREAS, The General Assembly wishes to encourage business
11and development within the State while encouraging injured
12parties to pursue meritorious claims when they are harmed due
13to the wrongdoing of others; and
 
14    WHEREAS, The General Assembly seeks to implement laws and
15policies that balance the interests of businesses and injured
16parties and that further a fair and efficient judicial system;
17therefore, be it
 
18    RESOLVED, BY THE SENATE OF THE NINETY-NINTH GENERAL
19ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
20CONCURRING HEREIN, that the Task Force on Civil Law Practice
21and Procedure is created to examine the number of lawsuits
22filed in Illinois, specifically from out-of-state parties;

1proper venue; liability of parties; the calculation of medical
2expenses; the effects of the Illinois civil justice system on
3the economic growth of the State; the specific proposals
4contained in Senate Bill 884, Senate Bill 2153, House Bill
54222, and House Bill 4246 of the 99th General Assembly; and be
6it further
 
7    RESOLVED, That the Task Force on Civil Law Practice and
8Procedure shall consist of 14 members who shall represent the
9diversity of the people, interests, and geography of the State
10and shall be appointed as follows:
 
11        (1) the Chairperson of the Senate Judiciary Committee
12    and the Chairperson of the House Judiciary - Civil
13    Committee, who shall serve as Co-Chairpersons of the Task
14    Force;
15        (2) 3 members appointed by the President of the Senate;
16        (3) 3 members appointed by the Speaker of the House of
17    Representatives;
18        (4) 2 members appointed by the Minority Leader of the
19    Senate;
20        (5) 2 members appointed by the Minority Leader of the
21    House of Representatives; and
22        (6) 2 members appointed by the Governor; and be it
23    further

1    RESOLVED, That the Task Force on Collective Bargaining
2Rights and Taxpayer Protection is created to examine the
3effects that local collective bargaining has on property taxes,
4study the likely effects of limiting the collective bargaining
5rights of local government employees; the specific proposals
6contained in Senate Bill 1046, Senate Bill 2152, House Bill
74224, and House Bill 4247 of the 99th General Assembly; and
8local tax policies, including but not limited to tax credits
9and exemptions; and be it further
 
10    RESOLVED, That the Task Force on Local Collective
11Bargaining and Taxpayer Protection shall consist of 14 members
12who shall represent the diversity of the people, interests, and
13geography of the State and shall be appointed as follows:
 
14        (1) the Chairperson of the Senate Labor Committee and
15    the Chairperson of the House Labor and Commerce Committee,
16    who shall serve as Co-Chairpersons of the Task Force;
17        (2) 3 members appointed by the President of the Senate;
18        (3) 3 members appointed by the Speaker of the House of
19    Representatives;
20        (4) 2 members appointed by the Minority Leader of the
21    Senate;
22        (5) 2 members appointed by the Minority Leader of the
23    House of Representatives; and
24        (6) 2 members appointed by the Governor; and be it

1    further
 
2    RESOLVED, That each Task Force shall hold meetings composed
3of a majority of the members appointed to receive testimony,
4and each Task Force meeting shall be open to the public with at
5least 6 days notice, which shall be posted on the General
6Assembly's website, www.ilga.gov; and be it further
 
7    RESOLVED, That at the call of the Co-Chairpersons, each
8Task Force shall conduct at least 4 public hearings in 4
9distinct geographic regions of the State before submitting its
10final report; and be it further
 
11    RESOLVED, That the Senate and House of Representatives
12shall provide administrative support to both Task Forces as
13needed and all members shall serve without compensation but
14shall be reimbursed for their reasonable and necessary travel
15expenses; and be it further
 
16    RESOLVED, That both Task Forces may consult with and seek
17advice and recommendations from subject matter experts for the
18purpose of examining specific issues within the purview of each
19respective Task Force; and be it further
 
20    RESOLVED, That each Task Force shall submit a report on its
21findings to the General Assembly and the Governor no later than

2    RESOLVED, That the final reports and any supporting
3documentation for each Task Force shall be made available to
4the public on the Illinois General Assembly's website,
5www.ilga.gov.".
