AMENDMENT TO HOUSE BILL 6098

2    AMENDMENT NO. ______. Amend House Bill 6098 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Open Meetings Act is amended by adding
5Section 1.06 as follows:
 
6    (5 ILCS 120/1.06 new)
7    Sec. 1.06. Publication by internet posting; digital
8maintenance of public records. Notwithstanding any other
9provision of law:
10    (a) Any requirement for a school district or a unit of
11local government to publish any notice, agenda, record, or
12other information or material in a newspaper by law including,
13but not limited to, the Open Meetings Act, the Illinois
14Municipal Budget Law, the Intergovernmental Cooperation Act,
15the Counties Code, the Township Code, the Illinois Municipal
16Code, the Election Code, the School Code, the Airport

1Authorities Act, or the Civic Center Code, may instead publish
2such notice, agenda, record, or other information on its
3website or data.illinois.gov.
4    (b) Any requirement that a school district or unit of local
5government store or maintain any public record in microfilm or
6microfiche form may be satisfied by the school district's or
7unit of local government's maintenance of such public record in
8digital form if meeting the standards and rules established
9under the Local Records Act and done pursuant to a retention
10schedule approved by the appropriate Local Records Commission.
 
11    Section 10. The Department of Central Management Services
12Law of the Civil Administrative Code of Illinois is amended by
13changing Section 405-335 as follows:
 
14    (20 ILCS 405/405-335)
15    Sec. 405-335. Illinois Transparency and Accountability
16Portal (ITAP).
17    (a) The Department, within 12 months after January 1, 2010
18(the effective date of Public Act 96-225) this amendatory Act
19of the 96th General Assembly, shall establish and maintain a
20website, known as the Illinois Transparency and Accountability
21Portal (ITAP), with a full-time webmaster tasked with compiling
22and updating the ITAP database with information received from
23all State agencies as defined in this Section. Within 6 months
24of the effective date of this amendatory Act of the 99th

1General Assembly, ITAP shall have the capability to compile and
2update the ITAP database with information received from all
3school districts and units of local government without websites
4including, but not limited to, counties, townships, special
5districts, and municipalities. Subject to appropriation, the
6full-time webmaster must also compile and update the ITAP
7database with information received from all school districts
8and units of local government including, but not limited to,
9counties, townships, special library districts, and
10municipalities.
11    (b) For purposes of this Section:
12    "State agency" means the offices of the constitutional
13officers identified in Article V of the Illinois Constitution,
14executive agencies, and departments, boards, commissions, and
15Authorities under the Governor.
16    "Contracts" means payment obligations with vendors on file
17with the Office of the Comptroller to purchase goods and
18services exceeding $10,000 in value (or, in the case of
19professional or artistic services, exceeding $5,000 in value).
20    "Appropriation" means line-item detail of spending
21approved by the General Assembly and Governor, categorized by
22object of expenditure.
23    "Individual consultants" means temporary workers eligible
24to receive State benefits paid on a State payroll.
25    "Recipients" means State agencies receiving
26appropriations.

1    (c) The ITAP shall provide direct access to each of the
2following:
3        (1) A database of all current State employees and
4    individual consultants, except sworn law enforcement
5    officers, sorted separately by:
6            (i) Name.
7            (ii) Employing State agency.
8            (iii) Employing State division.
9            (iv) Employment position title.
10            (v) Current pay rate and year-to-date pay.
11        (2) A database of all current State expenditures,
12    sorted separately by agency, category, recipient, and
13    Representative District.
14        (3) A database of all development assistance
15    reportable pursuant to the Corporate Accountability for
16    Tax Expenditures Act, sorted separately by tax credit
17    category, taxpayer, and Representative District.
18        (4) A database of all revocations and suspensions of
19    State occupation and use tax certificates of registration
20    and all revocations and suspensions of State professional
21    licenses, sorted separately by name, geographic location,
22    and certificate of registration number or license number,
23    as applicable. Professional license revocations and
24    suspensions shall be posted only if resulting from a
25    failure to pay taxes, license fees, or child support.
26        (5) A database of all current State contracts, sorted

1    separately by contractor name, awarding officer or agency,
2    contract value, and goods or services provided.
3        (6) A database of all employees hired after the
4    effective date of this amendatory Act of 2010, sorted
5    searchably by each of the following at the time of
6    employment:
7            (i) Name.
8            (ii) Employing State agency.
9            (iii) Employing State division.
10            (iv) Employment position title.
11            (v) Current pay rate and year-to-date pay.
12            (vi) County of employment location.
13            (vii) Rutan status.
14            (viii) Status of position as subject to collective
15        bargaining, subject to merit compensation, or exempt
16        under Section 4d of the Personnel Code.
17            (ix) Employment status as probationary, trainee,
18        intern, certified, or exempt from certification.
19            (x) Status as a military veteran.
20        (7) A searchable database of all current county,
21    township, library district, and municipal employees sorted
22    separately by:
23            (i) Employing unit of local government.
24            (ii) Employment position title.
25            (iii) Current pay rate and year-to-date pay.
26        (8) A searchable database of all county, township, and

1    municipal employees hired on or after the effective date of
2    this amendatory Act of the 97th General Assembly, sorted
3    separately by each of the following at the time of
4    employment:
5            (i) Employing unit of local government.
6            (ii) Employment position title.
7            (iii) Current pay rate and year-to-date pay.
8        (9) A searchable database of all library district
9    employees hired on or after August 9, 2013 (the effective
10    date of Public Act 98-246), sorted separately by each of
11    the following at the time of employment:
12            (i) Employing unit of local government.
13            (ii) Employment position title.
14            (iii) Current pay rate and year-to-date pay.
15        (10) A link to a website maintained by the Department
16    that contains a list of contact information for each State
17    agency, including a telephone number and a link to the
18    Agency's website. Each State agency shall be responsible
19    for providing and updating the Department with this
20    information.
21        (11) Notices and digital public records provided to
22    ITAP by school districts and units of local government
23    without websites.
24    (d) The ITAP shall include all information required to be
25published by subsection (c) of this Section that is available
26to the Department in a format the Department can compile and

1publish on the ITAP. The Department shall update the ITAP as
2additional information becomes available in a format that can
3be compiled and published on the ITAP by the Department.
4    (e) Each State agency, county, township, library district,
5and municipality shall cooperate with the Department in
6furnishing the information necessary for the implementation of
7this Section within a timeframe specified by the Department.
8    (f) Each county, township, library district, or
9municipality submitting information to be displayed on the
10Illinois Transparency and Accountability Portal (ITAP) is
11responsible for the accuracy of the information provided.
12    (g) The Department, within 6 months after January 1, 2014
13(the effective date of Public Act 98-283), shall distribute a
14spreadsheet or otherwise make data entry available to each
15State agency to facilitate the collection of data on the
16State's annual workforce characteristics, workforce
17compensation, and employee mobility. The Department shall
18determine the data to be collected by each State agency. Each
19State agency shall cooperate with the Department in furnishing
20the data necessary for the implementation of this subsection
21within the timeframe specified by the Department. The
22Department shall publish the data received from each State
23agency on the ITAP or another open data site annually.
