SYNOPSIS AS INTRODUCED:
 
105 ILCS 25/1.20 new

    Amends the Interscholastic Athletic Organization Act. Beginning with the 2016-2017 school year, requires an association or other entity that has, as one of its purposes, promoting, sponsoring, regulating, or in any manner providing for interscholastic athletics or any form of athletic competition among high schools and high school students within this State to require all member schools that have certified athletic trainers to complete a monthly report on student-athletes at the member school who have sustained a concussion. Beginning with the 2017-2018 school year, requires the association or entity to compile the data reported during the previous school year into an annual report and submit copies of this report to the General Assembly. Provides for immunity. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Interscholastic Athletic Organization Act
5is amended by adding Section 1.20 as follows:
 
6    (105 ILCS 25/1.20 new)
7    Sec. 1.20. Concussion reporting.
8    (a) Beginning with the 2016-2017 school year, an
9association or other entity that has, as one of its purposes,
10promoting, sponsoring, regulating, or in any manner providing
11for interscholastic athletics or any form of athletic
12competition among high schools and high school students within
13this State shall require all member schools that have certified
14athletic trainers to complete a monthly report on
15student-athletes at the member school who have sustained a
16concussion. All reporting must be anonymous as it relates to
17student names.
18    (b) Beginning with the 2017-2018 school year, the
19association or entity to which this Section applies shall
20compile the data reported under subsection (a) of this Section
21during the previous school year into an annual report and
22submit copies of this report to the General Assembly, as
23provided in Section 3.1 of the General Assembly Organization

1Act.
2    (c) With respect to reporting or failing to report under
3this Section, an association or entity to which this Section
4applies and any member school shall have immunity from any
5liability, whether civil or criminal or that otherwise might
6result by reason of such action or inaction, except for willful
7or wanton misconduct. However, the association or entity has
8the authority to take action against a member school if the
9member school fails to complete the required reporting.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.
