1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by changing
5Section 16-119 as follows:
 
6    (220 ILCS 5/16-119)
7    Sec. 16-119. Switching suppliers. An electric utility or an
8alternative retail electric supplier may establish a term of
9service, notice period for terminating service and provisions
10governing early termination through a tariff or contract. A
11customer may change its supplier subject to tariff or contract
12terms and conditions. Any notice provisions; or provision for a
13fee, charge or penalty with early termination of a contract;
14shall be conspicuously disclosed in any tariff or contract. Any
15tariff or contract that contains an early termination clause
16shall disclose the amount of the early termination fee,
17provided that any early termination fee or penalty shall not
18exceed $50 total, regardless of whether or not the tariff or
19contract is a multiyear tariff or contract. A customer shall
20remain responsible for any unpaid charges owed to an electric
21utility or alternative retail electric supplier at the time it
22switches to another provider.
