AMENDMENT TO HOUSE BILL 3616

2    AMENDMENT NO. ______. Amend House Bill 3616 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The University of Illinois Hospital Act is
5amended by adding Section 8a as follows:
 
6    (110 ILCS 330/8a new)
7    Sec. 8a. Patient notice of observation status. Within 24
8hours after a patient's placement into observation status by
9the University of Illinois Hospital, the University of Illinois
10Hospital shall provide that patient with an oral and written
11notice that the patient is not admitted to the hospital and is
12under observation status. The written notice shall be signed by
13the patient or the patient's legal representative to
14acknowledge receipt of the written notice and shall include,
15but not be limited to, the following information:
16        (1) a statement that observation status may affect

1    coverage under the federal Medicare program, the medical
2    assistance program under Article V of the Illinois Public
3    Aid Code, or the patient's insurance policy for the current
4    hospital services, including medications and other
5    pharmaceutical supplies, as well as coverage for any
6    subsequent discharge to a skilled nursing facility or for
7    home and community based care; and
8        (2) a statement that the patient should contact his or
9    her insurance provider to better understand the
10    implications of being placed into observation status.
 
11    Section 10. The Hospital Licensing Act is amended by adding
12Section 6.09b as follows:
 
13    (210 ILCS 85/6.09b new)
14    Sec. 6.09b. Patient notice of observation status. Within
1524 hours after a patient's placement into observation status by
16a hospital, the hospital shall provide that patient with an
17oral and written notice that the patient is not admitted to the
18hospital and is under observation status. The written notice
19shall be signed by the patient or the patient's legal
20representative to acknowledge receipt of the written notice and
21shall include, but not be limited to, the following
22information:
23        (1) a statement that observation status may affect

10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
