AMENDMENT TO HOUSE BILL 3485

2    AMENDMENT NO. ______. Amend House Bill 3485 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Fair
5Practices in Contracting Task Force Act.
 
6    Section 5. Purpose and members.
7    (a) There is created the Fair Practices in Contracting Task
8Force to:
9        (1) thoroughly survey African-American-owned business
10    participation in State procurement;
11        (2) study African-American-owned subcontractors'
12    ability to be paid in a timely manner and the communication
13    processes between subcontractors and prime contractors and
14    the State;
15        (3) research solutions and methods to address the
16    disparity in procurement awards; and

1        (4) produce a final report summarizing the Task Force's
2    findings and detailing recommended statutory or
3    constitutional strategies to recognize best practices.
4    (b) The Task Force shall consist of the following members:
5        (1) One member of the House of Representatives,
6    appointed by the Speaker of the House of Representatives;
7        (2) One member of the House of Representatives,
8    appointed by the Minority Leader of the House of
9    Representatives;
10        (3) One member of the Senate, appointed by the
11    President of the Senate;
12        (4) One member of the Senate, appointed by the Minority
13    Leader of the Senate;
14        (5) Four members appointed by the Governor, 3 of whom
15    must be from the Department of Central Management Services,
16    the Department of Transportation, or the Department of
17    Health and Family Services, and one of whom must be a
18    member of the Illinois African American Family Commission;
19    and
20        (6) Four members of the public, representing
21    minority-owned businesses, appointed by the Governor.
22    (c) Members shall serve without compensation.
 
23    Section 10. Meetings.
24    (a) The Task Force shall hold its first meeting by March 1,
252016.

1    (b) The Department of Central Management Services shall
2assist the Task Force and provide administrative support, but
3shall have no hand in guiding its direction or ascertaining its
4results.
5    (c) The Task Force shall meet quarterly and report its
6findings to the General Assembly and the appropriate
7committees.
8    (d) The Task Force shall submit its final report to the
9General Assembly and the Governor no later than December 31,
102017.
 
11    Section 15. Repeal date. This Act is repealed on January
122, 2019.".
