SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/1-8.6 new

    Amends the Illinois Public Aid Code. Provides that to the extent permitted by federal law and notwithstanding any other provision of the Code to the contrary, all persons incarcerated for at least 6 months at a county jail, juvenile detention center, or State correctional facility shall have their eligibility for medical assistance determined by the Department of Human Services prior to their release from custody. Grants the Department of Human Services rulemaking authority.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 1-8.6 as follows:
 
6    (305 ILCS 5/1-8.6 new)
7    Sec. 1-8.6. Incarcerated persons; medical assistance
8determinations. To the extent permitted by federal law and
9notwithstanding any other provision of this Code to the
10contrary, all persons incarcerated for at least 6 months at a
11county jail, juvenile detention center, or State correctional
12facility shall have their eligibility for medical assistance
13determined by the Department of Human Services prior to their
14release from custody. Counties, the Department of Juvenile
15Justice, the Department of Healthcare and Family Services, and
16the Department of Corrections shall cooperate with the
17Department of Human Services in implementing this Section. The
18Department of Human Services shall adopt any rules necessary to
19implement this provision.
