AMENDMENT TO HOUSE BILL 810

2    AMENDMENT NO. ______. Amend House Bill 810 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Rehabilitation of Persons with
5Disabilities Act is amended by changing Section 10 as follows:
 
6    (20 ILCS 2405/10)  (from Ch. 23, par. 3441)
7    Sec. 10. Residential schools; visual and hearing
8disabilities.
9    (a) The Department of Human Services shall operate
10residential schools for the education of children with visual
11and hearing disabilities who are unable to take advantage of
12the regular educational facilities provided in the community,
13and shall provide in connection therewith such academic,
14vocational, and related services as may be required. Children
15shall be eligible for admission to these schools only after
16proper diagnosis and evaluation, in accordance with procedures

1prescribed by the Department.
2    (a-5) The Superintendent of the Illinois School for the
3Deaf shall be the chief executive officer of, and shall be
4responsible for the day to day operations of, the School, and
5shall obtain educational and professional employees who are
6certified by the Illinois State Board of Education or licensed
7by the appropriate agency or entity to which licensing
8authority has been delegated, as well as all other employees of
9the School, subject to the provisions of the Personnel Code and
10any applicable collective bargaining agreement. The
11Superintendent shall be appointed by the Governor, by and with
12the advice and consent of the Senate. In the case of a vacancy
13in the office of Superintendent during the recess of the
14Senate, the Governor shall make a temporary appointment until
15the next meeting of the Senate, when the Governor shall
16nominate some person to fill the office, and any person so
17nominated who is confirmed by the Senate shall hold office
18during the remainder of the term and until his or her successor
19is appointed and qualified. The Superintendent shall hold
20office (i) for a term expiring on June 30 of 2015, and every 4
21years thereafter and (ii) until the Superintendent's successor
22is appointed and qualified. The Superintendent shall devote his
23or her full time to the duties of the office, shall not serve
24in any other capacity during his or her term of office, and
25shall receive such compensation as the Governor shall
26determine. For any Superintendent whose term begins before the

1effective date of this amendatory Act of the 99th General
2Assembly, the The Superintendent shall have an administrative
3certificate with a superintendent endorsement as provided for
4under Section 21-7.1 of the School Code, and shall have degrees
5in both educational administration and deaf education,
6together with at least 15 years of experience in either deaf
7education, the administration of deaf education, or a
8combination of the 2. For any Superintendent whose term begins
9on or after the effective date of this amendatory Act of the
1099th General Assembly, the Superintendent must (1) be
11proficient in sign language, (2) have a Professional Educator
12License with a superintendent endorsement as provided for under
13subdivision (D) of paragraph (2) of Section 21B-25 of the
14School Code or have comparable credentials from another state
15and must satisfy the requirements of subdivision (D) of
16paragraph (2) of Section 21B-25 of the School Code within an
17appropriate time as determined by the Department, and (3) have
18a master's degree or higher in educational administration or
19deaf education, together with at least 3 years of experience in
20either deaf education, the administration of deaf education, or
21a combination of the 2. In a situation in which an interim
22Superintendent is needed, the interim Superintendent must (A)
23be proficient in sign language, (B) have a master's degree or
24higher, and (C) have working knowledge of the federal
25Individuals with Disabilities Education Act, the federal
26Americans with Disabilities Act of 1990, and Section 504 of the

1federal Rehabilitation Act of 1973, together with
2administrative experience in serving the deaf and
3hard-of-hearing population.
4    (a-10) The Superintendent of the Illinois School for the
5Visually Impaired shall be the chief executive officer of, and
6shall be responsible for the day to day operations of, the
7School, and shall obtain educational and professional
8employees who are certified by the Illinois State Board of
9Education or licensed by the appropriate agency or entity to
10which licensing authority has been delegated, as well as all
11other employees of the School, subject to the provisions of the
12Personnel Code and any applicable collective bargaining
13agreement. The Superintendent shall be appointed by the
14Governor, by and with the advice and consent of the Senate. In
15the case of a vacancy in the office of Superintendent during
16the recess of the Senate, the Governor shall make a temporary
17appointment until the next meeting of the Senate, when the
18Governor shall nominate some person to fill the office, and any
19person so nominated who is confirmed by the Senate shall hold
20office during the remainder of the term and until his or her
21successor is appointed and qualified. The Superintendent shall
22hold office (i) for a term expiring on June 30 of 2015, and
23every 4 years thereafter and (ii) until the Superintendent's
24successor is appointed and qualified. The Superintendent shall

3administrative certificate with a superintendent endorsement
4as provided for under Section 21-7.1 of the School Code, and
5shall have degrees in both educational administration and blind
6or visually impaired education, together with at least 15 years
7of experience in either blind or visually impaired education,
8the administration of blind or visually impaired education, or
9a combination of the 2.
10    (b) In administering the Illinois School for the Deaf, the
11Department shall adopt an admission policy which permits day or
12residential enrollment, when resources are sufficient, of
13children with hearing disabilities who are able to take
14advantage of the regular educational facilities provided in the
15community and thus unqualified for admission under subsection
16(a). In doing so, the Department shall establish an annual
17deadline by which shall be completed the enrollment of children
18qualified under subsection (a) for admission to the Illinois
19School for the Deaf. After the deadline, the Illinois School
20for the Deaf may enroll other children with hearing
21disabilities at the request of their parents or guardians if
22the Department determines there are sufficient resources to
23meet their needs as well as the needs of children enrolled
24before the deadline and children qualified under subsection (a)
25who may be enrolled after the deadline on an emergency basis.
26The Department shall adopt any rules and regulations necessary

1for the implementation of this subsection.
2    (c) In administering the Illinois School for the Visually
3Impaired, the Department shall adopt an admission policy that
4permits day or residential enrollment, when resources are
5sufficient, of children with visual disabilities who are able
6to take advantage of the regular educational facilities
7provided in the community and thus unqualified for admission
8under subsection (a). In doing so, the Department shall
9establish an annual deadline by which the enrollment of
10children qualified under subsection (a) for admission to the
11Illinois School for the Visually Impaired shall be completed.
12After the deadline, the Illinois School for the Visually
13Impaired may enroll other children with visual disabilities at
14the request of their parents or guardians if the Department
15determines there are sufficient resources to meet their needs
16as well as the needs of children enrolled before the deadline
17and children qualified under subsection (a) who may be enrolled
18after the deadline on an emergency basis. The Department shall
19adopt any rules and regulations necessary for the
20implementation of this subsection.
