1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Natural Resources
5(Conservation) Law of the Civil Administrative Code of Illinois
6is amended by adding Section 805-537 as follows:
 
7    (20 ILCS 805/805-537 new)
8    Sec. 805-537. Conservation Police Officer quotas
9prohibited. The Department may not require a Conservation
10Police Officer to issue a specific number of citations within a
11designated period of time. This prohibition shall not affect
12the conditions of any federal or State grants or funds awarded
13to the Department and used to fund traffic enforcement
14programs.
15    The Department may not, for purposes of evaluating a
16Conservation Police Officer's job performance, compare the
17number of citations issued by the Conservation Police Officer
18to the number of citations issued by any other Conservation
19Police Officer who has similar job duties. Nothing in this
20Section shall prohibit the Department from evaluating a
21Conservation Police Officer based on the Conservation Police
22Officer's points of contact. For the purposes of this Section,
23"points of contact" means any quantifiable contact made in the

1furtherance of the Conservation Police Officer's duties,
2including, but not limited to, the number of traffic stops
3completed, arrests, written warnings, and crime prevention
4measures. Points of contact shall not include either the
5issuance of citations or the number of citations issued by a
6Conservation Police Officer.
 
7    Section 10. The State Police Act is amended by adding
8Section 24 as follows:
 
9    (20 ILCS 2610/24 new)
10    Sec. 24. State Police quotas prohibited. The Department may
11not require a Department of State Police officer to issue a
12specific number of citations within a designated period of
13time. This prohibition shall not affect the conditions of any
14federal or State grants or funds awarded to the Department and
15used to fund traffic enforcement programs.
16    The Department may not, for purposes of evaluating a
17Department of State Police officer's job performance, compare
18the number of citations issued by the Department of State
19Police officer to the number of citations issued by any other
20Department of State Police officer who has similar job duties.
21Nothing in this Section shall prohibit the Department from
22evaluating a Department of State Police officer based on the
23Department of State Police officer's points of contact. For the
24purposes of this Section, "points of contact" means any

2of State Police officer's duties, including, but not limited

6number of citations issued by a Department of State Police

8    Section 15. The Counties Code is amended by adding Section
95-1136 as follows:
 
10    (55 ILCS 5/5-1136 new)
11    Sec. 5-1136. Quotas prohibited. A county may not require a
12law enforcement officer to issue a specific number of citations
13within a designated period of time. This prohibition shall not
14affect the conditions of any federal or State grants or funds
15awarded to the county and used to fund traffic enforcement
16programs.
17    A county may not, for purposes of evaluating a law
18enforcement officer's job performance, compare the number of
19citations issued by the law enforcement officer to the number
20of citations issued by any other law enforcement officer who
21has similar job duties. Nothing in this Section shall prohibit
22a county from evaluating a law enforcement officer based on the
23law enforcement officer's points of contact.
24    For the purposes of this Section:

1        (1) "Points of contact" means any quantifiable contact
2    made in the furtherance of the law enforcement officer's
3    duties, including, but not limited to, the number of
4    traffic stops completed, arrests, written warnings, and
5    crime prevention measures. Points of contact shall not
6    include either the issuance of citations or the number of
7    citations issued by a law enforcement officer.
8        (2) "Law enforcement officer" includes any sheriff,
9    undersheriff, deputy sheriff, county police officer, or
10    other person employed by the county as a peace officer.
11    A home rule unit may not establish requirements for or
12assess the performance of law enforcement officers in a manner
13inconsistent with this Section. This Section is a denial and
14limitation of home rule powers and functions under subsection
15(g) of Section 6 of Article VII of the Illinois Constitution.
 
16    Section 20. The Illinois Municipal Code is amended by
17adding Section 11-1-12 as follows:
 
18    (65 ILCS 5/11-1-12 new)
19    Sec. 11-1-12. Quotas prohibited. A municipality may not
20require a police officer to issue a specific number of
21citations within a designated period of time. This prohibition
22shall not affect the conditions of any federal or State grants
23or funds awarded to the municipality and used to fund traffic
24enforcement programs.

1    A municipality may not, for purposes of evaluating a police
2officer's job performance, compare the number of citations
3issued by the police officer to the number of citations issued
4by any other police officer who has similar job duties. Nothing
5in this Section shall prohibit a municipality from evaluating a
6police officer based on the police officer's points of contact.
7For the purposes of this Section, "points of contact" means any
8quantifiable contact made in the furtherance of the police
9officer's duties, including, but not limited to, the number of
10traffic stops completed, arrests, written warnings, and crime
11prevention measures. Points of contact shall not include either
12the issuance of citations or the number of citations issued by
13a police officer.
14    This Section shall not apply to a municipality subject to
15Section 10-1-18.1 of this Code with its own independent
16inspector general and law enforcement review authority.
17    A home rule municipality may not establish requirements for
18or assess the performance of police officers in a manner
19inconsistent with this Section. This Section is a denial and
20limitation of home rule powers and functions under subsection
21(g) of Section 6 of Article VII of the Illinois Constitution.
