AMENDMENT TO SENATE BILL 3306

2    AMENDMENT NO. ______. Amend Senate Bill 3306 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Higher Education Student Assistance Act is
5amended by changing Section 35 as follows:
 
6    (110 ILCS 947/35)
7    Sec. 35. Monetary award program.
8    (a) The Commission shall, twice a each year, receive and
9consider applications for grant assistance under this Section.
10The first application period for grants for the next academic
11year shall be open to all eligible students who are applying
12for a grant. The second application period for grants for the
13next academic year shall occur no earlier than July 15. The
14second application period for grants for the next academic year
15shall be open only to:
16        (i) public community college students; or

1        (ii) public university students who missed the first
2    application deadline for good cause shown, as defined by
3    the Commission.
4The Commission shall apportion grant funds between persons who
5applied during the first application period and person who
6applied during the second application period, in such manner as
7the Commission shall determine.
8    Subject to a separate appropriation for the such purposes
9of this Section, an applicant is eligible for a grant under
10this Section when the Commission finds that the applicant:
11        (1) is a resident of this State and a citizen or
12    permanent resident of the United States; and
13        (2) in the absence of grant assistance, will be
14    deterred by financial considerations from completing an
15    educational program at the qualified institution of his or
16    her choice.
17    (b) The Commission shall award renewals only upon the
18student's application and upon the Commission's finding that
19the applicant:
20        (1) has remained a student in good standing;
21        (2) remains a resident of this State; and
22        (3) is in a financial situation that continues to
23    warrant assistance.
24    (c) All grants shall be applicable only to tuition and
25necessary fee costs. The Commission shall determine the grant
26amount for each student, which shall not exceed the smallest of

1the following amounts:
2        (1) subject to appropriation, $5,468 for fiscal year
3    2009, $5,968 for fiscal year 2010, and $6,468 for fiscal
4    year 2011 and each fiscal year thereafter, or such lesser
5    amount as the Commission finds to be available, during an
6    academic year;
7        (2) the amount which equals 2 semesters or 3 quarters
8    tuition and other necessary fees required generally by the
9    institution of all full-time undergraduate students; or
10        (3) such amount as the Commission finds to be
11    appropriate in view of the applicant's financial
12    resources.
13    Subject to appropriation, the maximum grant amount for
14students not subject to subdivision (1) of this subsection (c)
15must be increased by the same percentage as any increase made
16by law to the maximum grant amount under subdivision (1) of
17this subsection (c).
18    "Tuition and other necessary fees" as used in this Section
19include the customary charge for instruction and use of
20facilities in general, and the additional fixed fees charged
21for specified purposes, which are required generally of
22nongrant recipients for each academic period for which the
23grant applicant actually enrolls, but do not include fees
24payable only once or breakage fees and other contingent
25deposits which are refundable in whole or in part. The
26Commission may prescribe, by rule not inconsistent with this

1Section, detailed provisions concerning the computation of
2tuition and other necessary fees.
3    (d) No applicant, including those presently receiving
4scholarship assistance under this Act, is eligible for monetary
5award program consideration under this Act after receiving a
6baccalaureate degree or the equivalent of 135 semester credit
7hours of award payments.
8    (e) The Commission, in determining the number of grants to
9be offered, shall take into consideration past experience with
10the rate of grant funds unclaimed by recipients. The Commission
11shall notify applicants that grant assistance is contingent
12upon the availability of appropriated funds.
13    (f) The Commission may request appropriations for deposit
14into the Monetary Award Program Reserve Fund. Monies deposited
15into the Monetary Award Program Reserve Fund may be expended
16exclusively for one purpose: to make Monetary Award Program
17grants to eligible students. Amounts on deposit in the Monetary
18Award Program Reserve Fund may not exceed 2% of the current
19annual State appropriation for the Monetary Award Program.
20    The purpose of the Monetary Award Program Reserve Fund is
21to enable the Commission each year to assure as many students
22as possible of their eligibility for a Monetary Award Program
23grant and to do so before commencement of the academic year.
24Moneys deposited in this Reserve Fund are intended to enhance
25the Commission's management of the Monetary Award Program,
26minimizing the necessity, magnitude, and frequency of

1adjusting award amounts and ensuring that the annual Monetary
2Award Program appropriation can be fully utilized.
3    (g) The Commission shall determine the eligibility of and
4make grants to applicants enrolled at qualified for-profit
5institutions in accordance with the criteria set forth in this
6Section. The eligibility of applicants enrolled at such
7for-profit institutions shall be limited as follows:
8        (1) Beginning with the academic year 1997, only to
9    eligible first-time freshmen and first-time transfer
10    students who have attained an associate degree.
11        (2) Beginning with the academic year 1998, only to
12    eligible freshmen students, transfer students who have
13    attained an associate degree, and students who receive a
14    grant under paragraph (1) for the academic year 1997 and
15    whose grants are being renewed for the academic year 1998.
16        (3) Beginning with the academic year 1999, to all
17    eligible students.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
