    Amends the Counties Code and the Illinois Municipal Code. Provides that a household goods recycling bin shall have a permanent, written, printed label affixed to the bin and prominently displayed. Sets forth the required information that must be contained within the label. Defines required terms. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-1183 as follows:
 
6    (55 ILCS 5/5-1183 new)
7    Sec. 5-1183. Household goods recycling bins.
8    (a) Notwithstanding any other provision of law, a household
9goods recycling bin in any county shall have a permanent,
10written, printed label affixed to the bin and prominently
11displayed. The label shall include the name, address, and
12contact information of the person or entity owning, operating,
13or maintaining that bin. The person or entity owning,
14operating, or maintaining the bin shall also label the bin to
15designate if the person or entity owning, operating, or
16maintaining the bin is a "not for profit" or a "for profit"
17entity.
18    (b) As used in this Section:
19        "Household goods recycling bin" or "bin" means a
20    container or receptacle held out to the public as a place
21    for people to discard clothes, shoes, books, and other
22    recyclable items until they are taken away for resale,
23    re-use, recycling, or redistribution by the person or

1    entity that owns, operates, or maintains the bin.
2        "Not for profit" means any entity that is officially
3    recognized by the United States Internal Revenue Service as
4    a tax-exempt entity described in Section 501(c)(3) of the
5    Internal Revenue Code of 1986 (or any successor provision
6    of federal tax law).
 
7    Section 10. The Illinois Municipal Code is amended by
8adding Section 11-42-16 as follows:

10    Sec. 11-42-16. Household goods recycling bins.
11    (a) Notwithstanding any other provision of law, a household
12goods recycling bin in any municipality shall have a permanent,
13written, printed label affixed to the bin and prominently
14displayed. The label shall include the name, address, and
15contact information of the person or entity owning, operating,
16or maintaining that bin. The person or entity owning,
17operating, or maintaining the bin shall also label the bin to
18designate if the person or entity owning, operating, or
19maintaining the bin is a "not for profit" or a "for profit"
20entity.
21    (b) As used in this Section:
