SYNOPSIS AS INTRODUCED:

625 ILCS 5/7-601.5 new

    Amends the Illinois Vehicle Code. Provides that insurers shall collect a $1 surcharge upon each vehicle covered by a liability insurance policy. Provides that of the moneys collected by this surcharge, 72% shall be used for homeland security initiatives established by the Illinois Law Enforcement Alarm System (ILEAS) Governing Board, 25% shall be used for airborne operations, and 3% shall be retained by the Illinois Emergency Management Agency to be used to administer the Illinois Law Enforcement Alarm Systems Fund. Provides that the Illinois Emergency Management Agency shall establish guidelines for the expenditure of collected moneys to enhance local law enforcement homeland security and local law enforcement mutual aid activities in this State and to support public safety airborne operations. Provides that the ILEAS Governing Board shall annually supply the Director of the Illinois Emergency Management Agency with a report of the use of the surcharges. Amends the Intergovernmental Cooperation Act to provide that the Illinois Law Enforcement Alarm System shall be considered a public agency for purposes of the Act.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Intergovernmental Cooperation Act is
5amended by changing Section 2 as follows:
 
6    (5 ILCS 220/2)  (from Ch. 127, par. 742)
7    Sec. 2. Definitions. For the purpose of this Act:
8    (1) The term "public agency" shall mean any unit of local
9government as defined in the Illinois Constitution of 1970, any
10school district, any public community college district, any
11public building commission, the State of Illinois, any agency
12of the State government or of the United States, or of any
13other State, any political subdivision of another State, and
14any combination of the above pursuant to an intergovernmental
15agreement which includes provisions for a governing body of the
16agency created by the agreement.
17    For the purposes of this Act, "public agency" includes:
18        (A) the Mid-America Intermodal Authority Port District
19    created under the Mid-America Intermodal Authority Port
20    District Act; and
21        (B) the Illinois Law Enforcement Alarm System.
22    (2) The term "state" shall mean a state of the United
23States.

2    Section 10. The Illinois Vehicle Code is amended by adding
3Section 7-601.5 as follows:
 
4    (625 ILCS 5/7-601.5 new)
5    Sec. 7-601.5. Illinois Law Enforcement Alarm Systems
6insurance surcharge.
7    (a) Every insurance company or surety company authorized to
8do business in this State shall collect an annual surcharge of
9$1 for each vehicle covered by a liability insurance policy
10issued in accordance with Section 7-601 of this Code. The
11surcharge shall be collected at the same time and in the same
12manner that the premium or other charge for the insurance
13coverage is collected.
14    (b) Each month, the insurer shall remit all surcharge
15moneys collected to the Treasurer for deposit into the Illinois
16Law Enforcement Alarm Systems Fund.
17    (c) Moneys deposited into the Illinois Law Enforcement
18Alarm Systems Fund under this Section shall be allocated,
19subject to the approval of the Illinois Law Enforcement Alarm
20System (ILEAS) Governing Board, as follows: (i) 72% shall be
21used for homeland security initiatives established by the ILEAS
22Governing Board; (ii) 25% shall be used for airborne
23operations; and (iii) 3% shall be retained by the Illinois
24Emergency Management Agency to be used to administer the Fund.

1    (d) The Illinois Emergency Management Agency shall
2establish guidelines for the expenditure of surcharges
3collected under this Section. Under the guidelines, the
4expenditure of the surcharges shall enhance local law
5enforcement homeland security and local law enforcement mutual
6aid activities in this State and support public safety airborne
7operations. The ILEAS Governing Board shall annually provide
8the Director of the Illinois Emergency Management Agency with a
9report of the use of surcharges collected under this Section.
10    (e) This Section does not apply to vehicles owned by (i)
11units of local, State, or federal government and (ii)
12organizations based in this State that meet the requirements of
13Title 26, Section 501(c)(3) of the United States Code.
