AMENDMENT TO SENATE BILL 3017

2    AMENDMENT NO. ______. Amend Senate Bill 3017 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The University of Illinois Act is amended by
5adding Section 90 as follows:
 
6    (110 ILCS 305/90 new)
7    Sec. 90. Prohibition on use of State funds; boycott.
8    (a) The legislature finds that it is beneficial to students
9of this State to have access to an education that is not bound
10by borders and to have the opportunity to obtain a global
11education. The legislature further finds that it is important
12that this State undertake efforts to ensure that its students
13succeed in a world that is continually becoming more
14interdependent and diverse and, further, that students have
15access to international higher education institutions. A
16global education allows students to connect, compete, and

1cooperate with their peers around the world. Therefore, it is
2the policy of this State that public universities not use State
3funds to support boycotts of countries that are members of the
4Organisation for Economic Co-Operation and Development or
5higher education institutions located in those countries.
6    (b) The University may not use State aid provided directly
7to the University to fund an academic entity, provide funds for
8membership in an academic entity, or fund travel or lodging for
9any employee to attend a meeting of an academic entity if the
10academic entity has issued a public resolution or other
11official statement or undertaken an official action boycotting
12a country that is a member of the Organisation for Economic
13Co-Operation and Development or higher education institutions
14located in that country.
15    (c) Notwithstanding any other law to the contrary, the
16University is not eligible for State aid during the academic
17year in which the University is in violation of subsection (b)
18this Section.
19    (d) The provisions of this Section do not apply:
20        (1) if the country is determined by the United States
21    Secretary of State to be a state sponsor of terrorism;
22        (2) if the boycott is connected with a labor dispute;
23    or
24        (3) if the boycott is for the purpose of protesting
25    unlawful discriminatory practices, as determined by the
26    laws or administrative rules of this State.

1    (e) Nothing in this Section shall limit the attendance by
2any employee of the University at an event of an academic
3entity that boycotts a country that is a member of the
4Organisation for Economic Co-Operation and Development or
5higher education institutions located in that country, and
6attendance at meetings of any such academic entity must not be
7used by the University with regard to employment decisions.
 
8    Section 10. The Southern Illinois University Management
9Act is amended by adding Section 75 as follows:
 
10    (110 ILCS 520/75 new)
