AMENDMENT TO SENATE BILL 2928

2    AMENDMENT NO. ______. Amend Senate Bill 2928 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5changing Section 17.9A as follows:
 
6    (415 ILCS 5/17.9A)
7    Sec. 17.9A. Collection, storage, and transportation of
8pharmaceuticals by law enforcement agencies.
9    (a) Notwithstanding any other provision of this Act, to the
10extent allowed by federal law, a law enforcement agency may
11collect pharmaceuticals, including but not limited to
12controlled substances, from residential sources, store them,
13and transport them to a site or facility an incinerator
14permitted by the Agency to be incinerated in accordance with
15the permit, permit conditions, this Act, and rules adopted
16under this Act.

1    (b) Pharmaceuticals that have been transported to a
2permitted site or facility by a law enforcement agency under
3subsection (a) of this Section must be managed in accordance
4with this Act, rules adopted under this Act, and permits issued
5under this Act. If those pharmaceuticals are controlled
6substances, they must also be managed in accordance with
7federal and State laws and regulations governing controlled
8substances.
9    (c) For the purposes of this Section, "law enforcement
10agency" means an agency of the State or of a unit of local of
11government which is vested by law or ordinance with the duty to
12maintain public order and to enforce criminal laws.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
