AMENDMENT TO SENATE BILL 2226

2    AMENDMENT NO. ______. Amend Senate Bill 2226, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Environmental Protection Act is amended by
6adding Section 22.54a as follows:
 
7    (415 ILCS 5/22.54a new)
8    Sec. 22.54a. Disposal of asphalt roofing shingles. No owner
9or operator of a sanitary landfill that is located within a
1025-mile radius of a site where asphalt roofing shingles are
11recycled under a Beneficial Use Determination issued by the
12Agency pursuant to Section 22.54 of this Act (BUD) shall accept
13for disposal or for use as daily cover loads of whole or
14processed asphalt roofing shingles. Nothing in this Section
15shall prohibit or restrict a sanitary landfill from accepting
16for disposal asphalt roofing shingles that are commingled with

1municipal waste, including, but not limited to, general
2construction or demolition debris.
3    The Agency shall post on its website the name and address
4of each site at which the recycling of asphalt roofing shingles
5under a BUD is approved.
6    No later than January 31 of each year, each recipient of a
7BUD for asphalt roofing shingles shall submit a report to the
8Agency that contains the following information: (i) the total
9quantity of asphalt roofing shingles received under the BUD
10during the previous calendar year; (ii) the beneficial uses
11during the previous calendar year of shingles received under
12the BUD; (iii) the total quantity of shingles used in each
13beneficial use during the previous calendar year; and (iv) the
14total quantity and disposition of any shingles received but not
15beneficially used under the BUD during the previous calendar
16year. The report must be submitted on a form and in a format
17prescribed by the Agency.
18    This Section is repealed on February 1, 2018.".
