AMENDMENT TO SENATE BILL 1955

2    AMENDMENT NO. ______. Amend Senate Bill 1955, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
42, as follows:
 
5on page 1, line 6, after "85,", by inserting "95,"; and
 
6on page 24, line 22, by replacing "3" with "2"; and
 
7on page 28, immediately below line 21, by inserting the
8following:
 
9    "(410 ILCS 130/95)
10    (Section scheduled to be repealed on January 1, 2018)
11    Sec. 95. Background checks.
12    (a) The Department of Agriculture through the Department of
13State Police shall conduct a fingerprint-based criminal
14background check of the prospective cultivation center agents.

1Each prospective cultivation center agent shall submit his or
2her fingerprints to the Department of State Police in the form
3and manner prescribed by the Department of State Police. These
4fingerprints shall be checked against the fingerprint records
5filed in the Department of State Police and Federal Bureau of
6Investigation criminal history records databases. The
7Department of State Police shall furnish, pursuant to positive
8identification, all Illinois conviction information to the
9Department of Agriculture. The Department of State Police shall
10be reimbursed for the cost of the background check by the
11Department of Agriculture. In order to carry out this
12provision, each person applying as a cultivation center agent
13shall submit a full set of fingerprints to the Department of
14Agriculture for the purpose of obtaining a State and federal
15criminal records check. The Department of Agriculture may
16exchange this data with the Department of State Police and the
17Federal Bureau of Investigation without disclosing that the
18records check is related to this Act. The Department of
19Agriculture shall destroy each set of fingerprints after the
20criminal records check is complete.
21    (b) When applying for the initial permit, the background
22checks for the principal officer, board members, and registered
23agents shall be completed prior to submitting the application
24to the Department of Agriculture.

5agents in order to carry out this provision. Each prospective
6dispensing organization agent shall submit his or her
7fingerprints to the Department of State Police in the form and
8manner prescribed by the Department of State Police. These
9fingerprints shall be checked against the fingerprint records
10filed in the Department of State Police and Federal Bureau of
11Investigation criminal history records databases. The
12Department of State Police shall furnish, pursuant to positive
13identification, all Illinois conviction information to the
14Department of Financial and Professional Regulation. The
15Department of State Police shall be reimbursed for the cost of
16the background check by the Department of Financial and
17Professional Regulation. Each person applying as a dispensing
18organization agent shall submit a full set of fingerprints to
19the Department of Financial and Professional Regulation for the
20purpose of obtaining a state and federal criminal records
21check. The Department of Financial and Professional Regulation
22may exchange this data with the Department of State Police and
23the Federal Bureau of Investigation without disclosing that the
24records check is related to this Act. The Department of
25Financial and Professional Regulation shall destroy each set of
26fingerprints after the criminal records check is completed.".
