AMENDMENT TO SENATE BILL 1917

2    AMENDMENT NO. ______. Amend Senate Bill 1917 by replacing
3everything after the enacting clause with the following:

"ARTICLE 1. JOLIET CORRECTIONAL CENTER TRANSFER ACT

 
5    Section 1-1. Short title. This Act may be cited as the
6Joliet Correctional Center Transfer Act. References in this
7Article to "this Act" mean this Article.
 
8    Section 1-5. Authorization to sell.
9    (a) Notwithstanding any provision of law to the contrary,
10the Director of Central Management Services, on behalf of the
11State of Illinois, is hereby authorized to sell to the City of
12Joliet the site of the former Joliet Correctional Center,
13including: (i) the property commonly referred to as Prison
14West, which comprises approximately 20 acres on the west side
15of Collins Street in Joliet between Hills Avenue to the north

1and Woodruff Road to the south; (ii) the property commonly
2known as Prison East, which is located on the east side of
3Collins Street in Joliet and extends from Woodruff Road north
4to Dartmouth Avenue for approximately half a mile between those
5boundaries; and (iii) all structures and improvements thereon.
6The property shall be sold to the City of Joliet for the sum of
7$10.
8    (b) Any agreement to sell the former Joliet Correctional
9Center under this Section shall be entered into no later than
10one year after the effective date of this Act.
 
11    Section 1-10. Remediation. Notwithstanding the sale to the
12City of Joliet under Section 1-5, subject to appropriation, the
13Department of Central Management Services shall be responsible
14for the remediation of all environmental hazards present on the
15effective date of this Act at the property described in Section
161-5.
 
17    Section 1-15. Liability. Except as otherwise provided in
18Section 1-10, on and after the effective date of this Act, the
19City of Joliet shall indemnify the State of Illinois, the
20Department of Central Management Services, and the Department
21of Corrections from any and all liability for damages or
22injuries arising on the transferred premises, from any
23condition, hazard, or other danger existing thereon.

ARTICLE 5. JACKSONVILLE DEVELOPMENTAL CENTER TRANSFER ACT

 
2    Section 5-1. Short title. This Act may be cited as the
3Jacksonville Developmental Center Transfer Act. References in
4this Article to "this Act" mean this Article.
 
5    Section 5-5. Authorization to sell.
6    (a) Notwithstanding any provision of law to the contrary,
7the Director of Central Management Services, on behalf of the
8State of Illinois, is hereby authorized to sell to the City of
9Jacksonville any or all of the following parcels of property
10composing the former Jacksonville Developmental Center:
11        (1) PARCEL 1:
12    A part of the Northeast Quarter of Section 29, Township 15
13    North, Range 10 West of the Third Principal Meridian, in
14    Jacksonville, Morgan County, Illinois, described as
15    follows, using bearings and grid distances referenced to
16    the Illinois State Plane Coordinate System - West Zone, NAD
17    83 (2011):
18    Commencing at the Northwest Corner of the Northeast Quarter
19    of said Section 29; thence South 00 degrees 11 minutes 03
20    seconds West 76.45 feet along the west line of the
21    Northeast Quarter of said Section 29; thence South 89
22    degrees 56 minutes 32 seconds East 55.00 feet to a point on
23    the southerly existing right of way line of Morton Avenue,

1    (b) Each parcel of property described in subsection (a)
2shall be sold to the City of Joliet for the sum of $10.
3    (c) Any agreement or agreements to sell the parcels
4described in subsection (a) shall be entered into no later than
5one year after the effective date of this Act.
 
6    Section 5-10. Remediation. Notwithstanding the sale to the
7City of Jacksonville under Section 5-5, subject to
8appropriation, the Department of Central Management Services
9shall be responsible for the remediation of all environmental
10hazards present on the effective date of this Act at the
11property described in Section 5-5.
 
12    Section 5-15. Liability. Except as otherwise provided in
13Section 5-10, on and after the effective date of this Act, the
14City of Jacksonville shall indemnify the State of Illinois, the
15Department of Central Management Services, and the Department
16of Human Services from any and all liability for damages or
17injuries arising on the transferred premises, from any
18condition, hazard, or other danger existing thereon.

ARTICLE 99. EFFECTIVE DATE

 
20    Section 99-99. Effective date. This Act takes effect upon
21becoming law.".
