1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Safety Drill Act is amended by
5changing Sections 15 and 20 as follows:
 
6    (105 ILCS 128/15)
7    Sec. 15. Types of drills. Under this Act, the following
8school safety drills shall be instituted by all schools in this
9State:
10        (1) School evacuation drills, which shall address and
11    prepare students and school personnel for situations that
12    occur when conditions outside of a school building are
13    safer than inside a school building. Evacuation incidents
14    are based on the needs of particular communities and may
15    include without limitation the following:
16            (A) fire;
17            (B) suspicious items or persons;
18            (C) incidents involving hazardous materials,
19        including, but not limited to, chemical, incendiary,
20        and explosives; and
21            (D) bomb threats.
22        (2) Bus evacuation drills, which shall address and
23    prepare students and school personnel for situations that

1    occur when conditions outside of a bus are safer than
2    inside the bus. Evacuation incidents are based on the needs
3    of particular communities and may include without
4    limitation the following:
5            (A) fire;
6            (B) suspicious items; and
7            (C) incidents involving hazardous materials,
8        including, but not limited to, chemical, incendiary,
9        and explosives.
10        (3) Law enforcement drills, which shall address and
11    prepare students and school personnel for situations
12    calling for the involvement of law enforcement when
13    conditions inside a school building are safer than outside
14    of a school building and it is necessary to protect
15    building occupants from potential dangers in a school
16    building. Law enforcement drills may involve situations
17    that call for the reverse-evacuation or the lock-down of a
18    school building. Evacuation or reverse-evacuation
19    Evacuations incidents shall may include a shooting
20    incident. without limitation the following:
21            (A) shooting incidents;
22            (B) bomb threats;
23            (C) suspicious persons; and
24            (D) incidents involving hazardous materials.
25        (4) Severe weather and shelter-in-place drills, which
26    shall address and prepare students for situations

1    involving severe weather emergencies or the release of
2    external gas or chemicals. Severe weather and
3    shelter-in-place incidents shall be based on the needs and
4    environment of particular communities and may include
5    without limitation the following:
6            (A) severe weather, including, but not limited to,
7        shear winds, lightning, and earthquakes;
8            (B) incidents involving hazardous materials,
9        including, but not limited to, chemical, incendiary,
10        and explosives; and
11            (C) incidents involving weapons of mass
12        destruction, including, but not limited to,
13        biological, chemical, and nuclear weapons.

16    Sec. 20. Number of drills; incidents covered; local
17authority participation.
18    (a) During each academic year, schools must conduct a
19minimum of 3 school evacuation drills to address and prepare
20students and school personnel for fire incidents. These drills
21must meet all of the following criteria:
22        (1) One of the 3 school evacuation drills shall require
23    the participation of the appropriate local fire department
24    or district.
25            (A) Each local fire department or fire district

1        must contact the appropriate school administrator or
2        his or her designee no later than September 1 of each
3        year in order to arrange for the participation of the
4        department or district in the school evacuation drill.
5            (B) Each school administrator or his or her
6        designee must contact the responding local fire
7        official no later than September 15 of each year and
8        propose to the local fire official 4 dates within the
9        month of October, during at least 2 different weeks of
10        October, on which the drill shall occur. The fire
11        official may choose any of the 4 available dates, and
12        if he or she does so, the drill shall occur on that
13        date.
14            (C) The school administrator or his or her designee
15        and the local fire official may also, by mutual
16        agreement, set any other date for the drill, including
17        a date outside of the month of October.
18            (D) If the fire official does not select one of the
19        4 offered dates in October or set another date by
20        mutual agreement, the requirement that the school
21        include the local fire service in one of its mandatory
22        school evacuation drills shall be waived. Schools,
23        however, shall continue to be strongly encouraged to
24        include the fire service in a school evacuation drill
25        at a mutually agreed-upon time.
26            (E) Upon the participation of the local fire

1        service, the appropriate local fire official shall
2        certify that the school evacuation drill was
3        conducted.
4            (F) When scheduling the school evacuation drill,
5        the school administrator or his or her designee and the
6        local fire department or fire district may, by mutual
7        agreement on or before September 14, choose to waive
8        the provisions of subparagraphs (B), (C), and (D) of
9        this paragraph (1).
10        Additional school evacuation drills for fire incidents
11    may involve the participation of the appropriate local fire
12    department or district.
13        (2) Schools may conduct additional school evacuation
14    drills to account for other evacuation incidents,
15    including without limitation suspicious items or bomb
16    threats.
17        (3) All drills shall be conducted at each school
18    building that houses school children.
19    (b) During each academic year, schools must conduct a
20minimum of one bus evacuation drill. This drill shall be
21accounted for in the curriculum in all public schools and in
22all other educational institutions in this State that are
23supported or maintained, in whole or in part, by public funds
24and that provide instruction in any of the grades kindergarten
25through 12. This curriculum shall include instruction in safe
26bus riding practices for all students. Schools may conduct

1additional bus evacuation drills. All drills shall be conducted
2at each school building that houses school children.
3    (c) During each academic year, schools must conduct a law
4enforcement drill to address a school shooting incident
5incidents, including without limitation reverse evacuations,
6lock-downs, shootings, bomb threats, or hazardous materials.
7Such drills must be conducted according to the school
8district's or private school's emergency and crisis response
9plans, protocols, and procedures, with the participation of the
10appropriate law enforcement agency. Law enforcement drills may
11be conducted on days and times when students are not present in
12the school building. All drills must be conducted at each
13school building that houses school children.
14        (1) A law enforcement drill must meet all of the
15    following criteria:
16            (A) During each calendar year, the appropriate
17        local law enforcement agency shall contact the
18        appropriate school administrator to request to
19        participate in a law enforcement drill. The school
20        administrator and local law enforcement agency shall
21        set, by mutual agreement, a date for the drill.
22            (A-5) The drill shall require the on-site
23        participation of the local law enforcement agency. If a
24        mutually agreeable date cannot be reached between the
25        school administrator and the appropriate local law
26        enforcement agency, then the school shall still hold

1        the drill without participation from the agency. and
2        may actively participate on-site in a drill.
3            (B) Upon the participation of a local law
4        enforcement agency in a law enforcement drill, the
5        appropriate local law enforcement official shall
6        certify that the law enforcement drill was conducted
7        and notify the school in a timely manner of any
8        deficiencies noted during the drill.
9        (2) Schools may conduct additional law enforcement
10    drills at their discretion.
11        (3) (Blank).
12    (d) During each academic year, schools must conduct a
13minimum of one severe weather and shelter-in-place drill to
14address and prepare students and school personnel for possible
15tornado incidents and may conduct additional severe weather and
16shelter-in-place drills to account for other incidents,
17including without limitation earthquakes or hazardous
18materials. All drills shall be conducted at each school
19building that houses school children.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.
