SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Internet Posting Removal Act. Provides that a web site administrator shall, upon request, remove any posted comments posted by an anonymous poster unless the anonymous poster agrees to attach his or her name to the post and confirms that his or her IP address, legal name, and home address are accurate. Effective 90 days after becoming law.

1    AN ACT concerning the internet.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Internet Posting Removal Act.
 
6    Section 5. Definitions. As used in this Act, the following
7words and terms shall have the following meanings:
8    "Anonymous poster" means any individual who posts a message
9on a web site including social networks, blogs, forums, message
10boards, or any other discussion site where people can hold
11conversations in the form of posted messages.
12    "Internet" means the global system of interconnected
13computer networks that use the Internet Protocol.
14    "Internet Protocol address" or "IP address" means a
15numerical label assigned to each computer or device
16participating in a computer network that uses the Internet
17Protocol for communication.
18    "Web site administrator" means any person or entity that is
19responsible for maintaining a web site or managing the content
20or development of information provided on a web site including
21social networks, blogs, forums, message boards, or any other
22discussion site where people can hold conversations in the form
23of posted messages accessible via a network such as the

1Internet or a private local area network.
 
2    Section 10. Anonymous internet poster; right to know. A web
3site administrator upon request shall remove any comments
4posted on his or her web site by an anonymous poster unless the
5anonymous poster agrees to attach his or her name to the post
6and confirms that his or her IP address, legal name, and home
7address are accurate. All web site administrators shall have a
8contact number or e-mail address posted for such removal
9requests clearly visible in any sections where comments are
10posted.
 
11    Section 99. Effective date. This Act takes effect 90 days
12after becoming law.
