AMENDMENT TO HOUSE BILL 4896

2    AMENDMENT NO. ______. Amend House Bill 4896 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Personnel Code is amended by adding Section
526 as follows:
 
6    (20 ILCS 415/26 new)
7    Sec. 26. Reinstatement; Department of Corrections.
8    (a) The Department of Corrections shall provide for the
9reinstatement of former certified employees who had resigned,
10who were terminated in good standing, or whose positions were
11reallocated downward.
12    (b) If an employee who had resigned, who was terminated in
13good standing, or whose position was reallocated downward
14reapplies for a position, the Department of Corrections, with
15prior approval from the Department of Central Management
16Services, must consider the employee before all other

1applicants. Such reinstatement may be to a position in the
2class to which the employee was assigned prior to resignation,
3termination, or downward allocation, or to a position in any
4other position class for which the employee is qualified.
5    (c) A certified employee whose name appears on a
6reemployment list may be reinstated to a position other than
7the position to which the employee is eligible for
8reemployment. If reinstated to a position in a higher pay grade
9than that for which the employee is eligible for reemployment,
10then, upon satisfactory completion of a 3-month probationary
11period, the employee's name shall be removed from the
12reemployment list. If an employee is reinstated to a position
13in a lower pay grade than that for which the employee is
14eligible for reemployment, it shall have no effect on the
15employee's reemployment rights.
16    (d) The Department of Corrections shall determine
17eligibility for vacation time and other benefits based on prior
18length of service of the former employees who are eligible for
19reinstatement.
20    (e) The Director of Corrections may reinstate an employee
21who was formerly certified under the Secretary of State Merit
22Employment Code, the University Civil Service System of
23Illinois, the Comptroller Merit Employment Code, or the State
24Treasurer Employment Code.
 
25    Section 99. Effective date. This Act takes effect upon
