AMENDMENT TO HOUSE BILL 4593

2    AMENDMENT NO. ______. Amend House Bill 4593 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6adding Section 2105-17 as follows:
 
7    (20 ILCS 2105/2105-17 new)
8    Sec. 2105-17. Volunteer licenses.
9    (a) For the purposes of this Section:
10    "Health care professional" means a physician licensed
11under the Medical Practice Act of 1987, a dentist licensed
12under the Illinois Dental Practice Act, a physician assistant
13licensed under the Physician Assistant Practice Act of 1987,
14and a nurse or advanced practice nurse licensed under the Nurse
15Practice Act. The Department may expand this definition by
16rule.

1    "Volunteer practice" means the practice of a licensed
2health care profession for the benefit of an individual or the
3public and without compensation for the health care services
4provided.
5    (b) The Department may grant a volunteer license to a
6health care professional who:
7        (1) meets all requirements of the State licensing Act
8    that applies to his or her health care profession and the
9    rules adopted under the Act; and
10        (2) agrees to engage in the volunteer practice of his
11    or her health care profession in a free medical clinic, as
12    defined in the Good Samaritan Act, or in a public health
13    clinic, as defined in Section 6-101 of the Local
14    Governmental and Governmental Employees Tort Immunities
15    Act, and to not practice for compensation.
16    (c) A volunteer license shall be granted in accordance with
17the licensing Act that applies to the health care
18professional's given health care profession, and the licensure
19fee shall be set by rule in accordance with subsection (f).
20    (d) No health care professional shall hold a non-volunteer
21license in a health care profession and a volunteer license in
22that profession at the same time. In the event that the health
23care professional obtains a volunteer license in the profession
24for which he or she holds a non-volunteer license, that
25non-volunteer license shall automatically be placed in
26inactive status. In the event that a health care professional

1obtains a non-volunteer license in the profession for which he
2or she holds a volunteer license, the volunteer license shall
3be placed in inactive status. Practicing on an expired
4volunteer license constitutes the unlicensed practice of the
5health care professional's profession.
6    (e) Nothing in this Section shall be construed to waive or
7modify any statute, rule, or regulation concerning the
8licensure or practice of any health care profession. A health
9care professional who holds a volunteer license shall be
10subject to all statutes, rules, and regulations governing his
11or her profession. The Department shall waive the licensure fee
12for the first 500 volunteer licenses issued and may by rule
13provide for a fee waiver or fee reduction that shall apply to
14all licenses issued after the initial 500.
15    (f) The Department shall determine by rule the total number
16of volunteer licenses to be issued. The Department shall file
17proposed rules implementing this Section within 6 months after
18the effective date of this amendatory Act of the 98th General
19Assembly.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
