AMENDMENT TO HOUSE BILL 4584

2    AMENDMENT NO. ______. Amend House Bill 4584 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Navigator Certification Act is amended by
5adding Section 22 as follows:
 
6    (215 ILCS 121/22 new)
7    Sec. 22. Criminal history record check; application for
8certificate and certificate renewal.
9    (a) For the purpose of this Section, "fingerprints" means
10an impression of the lines on the finger taken for the purpose
11of identification. The impression may be electronic or in ink
12converted to electronic format.
13    (b) In order to make a determination of certification
14eligibility, the Director is authorized to require all
15applicants for a certificate to undergo a fingerprint-based
16criminal history record check for an initial certificate and,

1for an individual holding a certificate on the effective date
2of this amendatory Act of the 98th General Assembly, for the
3first renewal of a certificate. The applicant shall submit his
4or her fingerprints to the Department of State Police in the
5form and manner prescribed by the Department of State Police.
6The fingerprints shall be transmitted by a live scan
7fingerprint vendor licensed by the Department of Financial and
8Professional Regulation. The fingerprints shall be checked
9against the fingerprint records filed in the Department of
10State Police and Federal Bureau of Investigation criminal
11history records databases. The Department of State Police shall
12charge a fee for conducting the criminal history record check,
13which shall be deposited in the State Police Services Fund and
14shall not exceed the actual cost of the State and national
15criminal history record check. The Department of State Police
16shall furnish, pursuant to positive identification, all
17Illinois conviction information to the Department of Insurance
18and shall forward the national criminal history record
19information to the Department of Insurance.".
