AMENDMENT TO HOUSE BILL 2974

2    AMENDMENT NO. ______. Amend House Bill 2974 on page 1,
3immediately below line 3, by inserting the following:
 
4    "Section 3. The Illinois Conservation Foundation Act is
5amended by changing Section 15 as follows:
 
6    (20 ILCS 880/15)
7    Sec. 15. Organization, powers, and duties of Foundation. As
8soon as practical after the Foundation is created, the Board of
9Directors shall meet, organize, and designate, by majority
10vote, a treasurer, secretary, and any additional officers that
11may be needed to carry out the activities of the Foundation,
12and shall adopt bylaws of the Foundation. The Department of
13Natural Resources may adopt other rules deemed necessary to
14govern Foundation procedures.
15    The Foundation may accept gifts or grants from the federal
16government, its agencies or officers, or from any person, firm,

1or corporation, and may expend receipts on activities that it
2considers suitable to the performance of its duties under this
3Act and consistent with any requirement of the grant, gift, or
4bequest. Funds collected by the Foundation shall be considered
5private funds, except those received from public entities, and
6shall be held in an appropriate account outside of the State
7Treasury. Private funds collected by the Foundation are not
8subject to the Public Funds Investment Act. The Foundation is
9exempt from the Accountability for the Investment of Public
10Funds Act. Foundation procurement is exempt from the Illinois
11Procurement Code when only private funds are used for
12procurement expenditures. The treasurer of the Foundation
13shall be custodian of all Foundation funds. The Foundation's
14accounts and books shall be set up and maintained in a manner
15approved by the Auditor General; and the Foundation and its
16officers shall be responsible for the approval of recording of
17receipts, approval of payments, and the proper filing of
18required reports. The Foundation may be assisted in carrying
19out its functions by personnel of the Department of Natural
20Resources. The Department shall provide reasonable assistance
21to the Foundation to achieve the purposes of the Foundation.
22The Foundation shall cooperate fully with the boards,
23commissions, agencies, departments, and institutions of the
24State. The funds held and made available by the Illinois
25Conservation Foundation shall be subject to financial and
26compliance audits by the Auditor General in compliance with the

1Illinois State Auditing Act.
2    The Foundation shall not have any power of eminent domain.

4    Section 4. The Accountability for the Investment of Public
5Funds Act is amended by adding Section 12 as follows:
 
6    (30 ILCS 237/12 new)
7    Sec. 12. Exemptions. This Act does not apply to the
8Illinois Conservation Foundation Act.".
