SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1432 new

    Amends the Illinois Vehicle Code. Provides that no person may smoke cigarettes, cigars, or pipes of any kind in a motor vehicle containing a minor under 13 years of age. Provides that a violation of this Section is a petty offense subject to a fine not to exceed $100. Provides that a violation of this Section is not cause to stop or search a motor vehicle or the driver of a motor vehicle.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 11-1432 as follows:
 
6    (625 ILCS 5/11-1432 new)
7    Sec. 11-1432. Smoking in a motor vehicle with a minor
8present.
9    (a) For the purposes of this Section, "smoke" means the
10possession of any lighted pipe, cigar, or cigarette of any kind
11or any other lighted smoking equipment or the lighting,
12inhaling, or exhaling of smoke from a pipe, cigar, or cigarette
13of any kind.
14    (b) It shall be unlawful for a person to smoke in a motor
15vehicle, whether in motion or at rest, that contains a person
16younger than 13 years of age.
17    (c) A person that violates this Section shall be guilty of
18a petty offense and subject to a fine not to exceed $100.
19    (d) A law enforcement officer may not stop or search a
20motor vehicle, its contents, the driver, or a passenger solely
21because of a violation or suspected violation of this Section.
