1    AN ACT concerning health facilities.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Home Health, Home Services, and Home Nursing
5Agency Licensing Act is amended by adding Section 6.4 as
6follows:
 
7    (210 ILCS 55/6.4 new)
8    Sec. 6.4. Oversight and direction of skilled home care
9services. A physician licensed in another state may oversee or
10direct the delivery of skilled home care services provided by
11home health and home nursing agencies licensed in Illinois
12following care or treatment originally provided to the patient
13in the state in which the physician is licensed to practice
14medicine until care is transitioned to a physician licensed to
15practice medicine in all its branches in Illinois under the
16following conditions:
17        (1) The out-of-state physician shall ask the patient
18    whether the patient has a primary care physician in
19    Illinois. If the patient has a primary care physician in
20    Illinois, the out-of-state physician shall contact the
21    primary care physician and obtain the concurrence of that
22    individual for ordering home health care services. The
23    out-of-state physician shall make a notation of that

1    contact in the patient's medical record.
2        (2) The transition period may not exceed 90 days of
3    skilled home care services except as provided by paragraph
4    (3) of this Section.
5        (3) The transition period may be up to 180 days of
6    skilled home care services for patients where home health
7    services are needed to care for 2 or more medical
8    conditions requiring intensive management by 2 or more
9    physicians, with documentation supporting unsuccessful
10    efforts in identifying an appropriate physician in
11    Illinois within the initial 90-day time period.
12        (4) Any significant change in the patient's condition
13    shall be communicated by the Illinois licensed agency to
14    the out-of-state physician and the patient's Illinois
15    licensed physician.
16        (5) A copy of the license or evidence of licensure by
17    another state of the out-of-state physician must be
18    retained in the patient's chart.
