1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Nurse Practice Act is amended by changing
5Section 75-15 as follows:
 
6    (225 ILCS 65/75-15)  (was 225 ILCS 65/17-15)
7    (Section scheduled to be repealed on January 1, 2018)
8    Sec. 75-15. Center for Nursing Advisory Board.
9    (a) There is created the Center for Nursing Advisory Board,
10which shall consist of 11 members appointed by the Governor,
11with 6 members of the Advisory Board being nurses
12representative of various nursing specialty areas. The other 5
13members may include representatives of associations, health
14care providers, nursing educators, and consumers. The Advisory
15Board shall be chaired by the Nursing Act Coordinator, who
16shall be a voting member of the Advisory Board.
17    (b) The membership of the Advisory Board shall reasonably
18reflect representation from the geographic areas in this State.
19    (c) Members of the Advisory Board appointed by the Governor
20shall serve for terms of 4 years, with no member serving more
21than 10 successive years, except that, initially, 4 members
22shall be appointed to the Advisory Board for terms that expire
23on June 30, 2009, 4 members shall be appointed to the Advisory

1Board for terms that expire on June 30, 2008, and 3 members
2shall be appointed to the Advisory Board for terms that expire
3on June 30, 2007. A member shall serve until his or her
4successor is appointed and has qualified. Vacancies shall be
5filled in the same manner as original appointments, and any
6member so appointed shall serve during the remainder of the
7term for which the vacancy occurred.
8    (d) A quorum of the Advisory Board shall consist of a
9majority of Advisory Board members currently serving. A
10majority vote of the quorum is required for Advisory Board
11decisions. A vacancy in the membership of the Advisory Board
12shall not impair the right of a quorum to exercise all of the
13rights and perform all of the duties of the Advisory Board.
14    (e) The Governor may remove any appointed member of the
15Advisory Board for misconduct, incapacity, or neglect of duty
16and shall be the sole judge of the sufficiency of the cause for
17removal.
18    (f) Members of the Advisory Board are immune from suit in
19any action based upon any activities performed in good faith as
20members of the Advisory Board.
21    (g) Members of the Advisory Board shall not receive
22compensation, but shall be reimbursed for actual traveling,
23incidentals, and expenses necessarily incurred in carrying out
24their duties as members of the Advisory Board, as approved by
25the Department.
26    (h) The Advisory Board shall meet annually to elect a

1chairperson and vice chairperson.

3    Section 99. Effective date. This Act takes effect upon
4becoming law.
