AMENDMENT TO HOUSE BILL 2379

2    AMENDMENT NO. ______. Amend House Bill 2379 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Food, Drug and Cosmetic Act is
5amended by adding Section 3.24 as follows:
 
6    (410 ILCS 620/3.24 new)
7    Sec. 3.24. Energy drinks.
8    (a) The General Assembly finds the following:
9        (1) The effects of energy drinks, when taken in
10    excessive doses, include increased heart rates, anxiety,
11    jitteriness, headache, and fatigue.
12        (2) There are no conclusive, intensive studies on the
13    combined effect of taurine and caffeine in humans.
14        (3) Rats fed taurine and caffeine exhibited bizarre
15    behavior, including anxiety, irritability, sensitivity to
16    noise, and self-mutilation.

1    (b) For the purpose of this Section, "energy drink" means
2any drink with a caffeine level of 6 mg or more per ounce.
3    (c) It is unlawful in this State for any person to sell,
4offer for sale, or deliver an energy drink to a person under 18
5years of age. It is unlawful in this State for any entity to
6target an advertisement of a provocatively named energy drink,
7such as Cocaine, towards adolescents. In addition to any other
8remedies provided by law, the Director is authorized to file a
9complaint and apply to the circuit court for, and such court
10may upon hearing and for cause shown grant, a temporary
11restraining order or preliminary or permanent injunction
12restraining any person from violating any provision of this
13subsection (c).".
